Public works and town roads — Malabar, Florida

Malabar keeps only the streets its council has accepted: Rocky Point Road, Weber Road and the lanes off Malabar Road, while US 1 and SR 514 are state roads.

Short answer: The Town of Malabar maintains only the streets its Town Council has accepted, listed on the town's accepted streets list (as of 1/25/2024), such as Rocky Point Road, Weber Road and Jordan Blvd. US 1, Malabar Road (SR 514) and Babcock Street (SR 507) are arterial roads outside that list. Road, drainage and right-of-way problems go to Malabar Public Works through its online service request form or Town Hall at 321-727-7764 option 2; the Public Works Building is at 1435 Centre Street.

Which Malabar roads does the town maintain?

The Town of Malabar maintains only the streets its Town Council has formally accepted, and Public Works posts that inventory as Approved Roads as of 05/05/2025 (Public Works).

The document behind that link is titled Public Rights-of-Way Accepted Streets as of 1/25/2024 and lists each accepted Malabar street with its pavement width and the length the town took over (Accepted Streets, page 1). Chapter 13 of the Malabar Code explains why the list matters: an unaccepted road is any unimproved road or right-of-way that has not been accepted by the town for maintenance by affirmative vote of the town council and placed on the official list (Code Chapter 13). A dirt lane can be public right-of-way in Malabar without being a town-maintained road.

The longer town roads are the old spines of the community. Rocky Point Road runs 7,590 feet paved at 22 feet wide and is noted on the list as the old Hwy 1 (Accepted Streets, page 2). Weber Road is paved for 2 miles south from Malabar Road to the town limits, and Township Road runs 1,056 feet paved from the FEC railroad to US 1 (Accepted Streets, page 3). The earlier list of May 10, 2004 recorded Corey Road at 10,560 feet paved south from Malabar Road to the south town limit and noted that it did not include all town-owned right-of-way (2004 Accepted Streets list).

Rocky Point Road22 feet7,590 feet paved (old Hwy 1)
Weber Road23 feet2 miles paved south from Malabar Road to town limits
Jordan Blvd70 feet1,010 feet paved west of US 1 (divided road)
Old Mission Rd18 feet1,950 feet west from Weber Road to Beran Lane
Huggins Drive22 feet808 feet paved east from US 1
Township Road20 feet1,056 feet paved, FEC railroad to US 1

The Malabar list also names rights-of-way the town does not maintain. Beekeeper Ln, east from Corey Road, is a public right-of-way named only for fire-fighting location purposes and is marked NOT AN ACCEPTED STREET; Candy Lane south of Atz Rd shows no record in file of any improvement; and Alexander Lane is a private easement that is not maintained by the Town (Accepted Streets, page 3).

Which roads through Malabar belong to the state, and who lights them?

US 1, Malabar Road (SR 514) and Babcock Street (SR 507) are the arterial roadways through Malabar; the town's own network is the collector and local streets that feed them.

Land Development Code Table 1-3.3(E) groups Malabar thoroughfares by class: arterial roadways with 150-foot rights-of-way (US 1, Malabar Road and Babcock Street), major collector streets with 100-foot rights-of-way (Corey Road, Weber Road, Marie Street and Jordan Blvd.) and minor collector streets with 70-foot rights-of-way (Atz, Hall Road, Old Mission Road and Benjamin or Reese Road) (Land Development Code Article III). The town's 2023 pavement study confirms the split: the Malabar roads connect to multiple arterial roads, but there are no arterial roads on the list of roads being evaluated (pavement evaluation presentation, page 14).

Street lighting crosses that line. Florida Power and Light powers and maintains the streetlights in the Town of Malabar, the town pays for the electricity on both town and state roads, and the Florida Department of Transportation reimburses Malabar for the lights on Malabar Road and US 1 (May 18, 2026 agenda, page 86). Resolution 06-2026, approving the agreement for the next fiscal year, was on the May 18, 2026 Town Council agenda. The quantity sheet signed in October 2025 covers 17 luminaires for FY 26/27 (July 1, 2026 to June 30, 2027) (lighting quantity verification), located on US 1 from Rocky Point Road to north of Huggins Drive and on SR 514 from 750 Malabar Road to 1840 Malabar Road (quantity verification, page 2).

Inside the residential neighborhoods, Chapter 13 sets a maximum speed limit of twenty (20) miles per hour on all residential streets in the RS-10, RS-15, RM-4, RM-6, RM-H and RLC zoning districts of Malabar (Code Section 13-1). The rural residential RR-65 areas are not on that list.

How is a pothole, ditch or right-of-way problem reported in Malabar?

Malabar Public Works takes requests through an online service request form, or by phone at Malabar Town Hall, 321-727-7764 option 2 (Public Works).

The Malabar form offers three categories: Road Maintenance Problems, Drainage Maintenance Problems, and Overgrown Shrubbery in Right-of-Way. It asks for the location of the problem and a description, accepts photos, and lets the sender choose follow up by phone, email or not at all. The same page pictures the crew's work: a slope mower, ditch maintenance, culvert installation and grading machinery (Public Works).

How does a dirt road in Malabar become a town-maintained road?

A Malabar dirt road becomes a town road only after it is built to town standards, inspected, and accepted for maintenance by a vote of the Town Council.

Chapter 13 puts the cost of the first improvement on the builder. Before a permit for a new residence on property that abuts an unimproved or unaccepted local road, the owner must provide for the improvement of the local street/road from which a person will obtain primary ingress and egress, running from the nearest improved and accepted road through the far boundary of the lot; the owner must also dedicate the abutting strip of right-of-way to the town (Code Sections 13-38 and 13-39). The Malabar Town Council may grant a waiver (Section 13-38(c)), and the May 18, 2026 council agenda scheduled a public hearing on a road improvement waiver for Gator Way Lane under Resolution 04-2026 (May 18, 2026 agenda, page 2).

Section 13-42 lays out the route to acceptance as a numbered list of twelve items, one of them reserved: a sealed right-of-way survey, engineer-sealed plans meeting the Malabar roadway specifications, a roadway improvement permit, a licensed contractor, three inspections through the building department, soils test reports, as-built drawings, certification by the town's engineering firm, cost documentation, and a request to place formal acceptance on the next regular town council agenda (Code Section 13-42).

The builder can recover part of the bill. Under Section 13-47, a later owner who wants a development permit on a Malabar parcel abutting the improved section pays an amount equal to their pro rata share of the total certified costs, figured by front feet, and the town passes that money to whoever paid for the road (Code Section 13-47). That is why many entries on the accepted streets list carry a payback note, such as Let Lane, where several parcels owe payback under Ord 91-2 (Accepted Streets, page 2).

Neighbors can also ask the town to pave. Under Section 13-52, owners of two-thirds or more of the front footage on a Malabar street can petition the Town Council for paving by special assessment, and for an improved and accepted dirt lane the town counts a reduction by forty (40) percent of the cost as its share, paid only from transportation impact fees collected on new construction (Code Section 13-52).

Which paved Malabar roads were ranked first for resurfacing?

Briar Creek Boulevard, Weber Road, Rocky Point Road and Corey Road held the top four adjusted ranks on the Malabar resurfacing priority list (priority list, pages 4 to 7).

The list went to the Malabar Town Council on April 3, 2023 with a town-wide asphalt pavement evaluation (agenda item 13.b, April 3, 2023). Engineering Design and Construction Inc. surveyed all asphalt paved roads owned and maintained by the Town of Malabar and left out unpaved roads and asphalt millings roads (pavement evaluation, page 5). Raw distress scores were then adjusted by road type, with multipliers of 0.50 for a local road, 1 for a collector and 1.5 for an arterial, and by observed traffic (pavement evaluation, page 14). That adjustment is why Coral Way, with the worst raw distress score in Malabar (23, rank 1), fell to ninth once its local role was counted (priority list, page 9).

Briar Creek BoulevardCollector22/1Mill and structural overlay
Weber RoadCollector19.5/2Structural investigation; overlay or reconstruction
Rocky Point RoadCollector15/3Structural investigation; overlay
Coral WayLocal5.75/9Structural investigation; overlay or reconstruction

Briar Creek Boulevard ranked first because it is the sole ingress and egress for the Brook Hollow subdivision, and the list notes the potential to piggyback on a City of Palm Bay contract (priority list, page 4). Weber Road is described as the primary connector for other Malabar collector roads and Malabar Road (priority list, page 5). Rocky Point Road carried storm damage requiring partial reconstruction with FEMA funding (priority list, page 6); the Malabar Public Works pages now carry a separate Rocky Point Road Reconstruction section (Public Works). Benjamin Road, which connects several dirt roads in Malabar and Grant-Valkaria to Corey Road, was flagged for potential to cost share with Grant-Valkaria (priority list, page 8).

Who collects garbage and recycling in Malabar?

Waste Pro USA has been the solid waste removal contractor for the Town of Malabar since January 1, 2022 (Solid Waste).

The Malabar Solid Waste page lists garbage on Tuesday and Friday and yard waste on Monday, and posts a later change that moved recycling from Wednesday to Thursday. Service, billing and cart questions go to Waste Pro at (321) 837-0055. The switch followed Request for Proposal 2021-01, published July 13, 2021 after Waste Management said a renewal of its 2014 contract would raise costs; Waste Pro of Florida and Republic Services submitted proposals, and the evaluation committee unanimously recommended negotiating with Waste Pro (Solid Waste).

Frequently asked questions

Does the Town of Malabar maintain every road inside town limits?

No. Malabar maintains only streets the Town Council has accepted and placed on its accepted streets list. US 1, Malabar Road and Babcock Street are arterial roads outside that list, and some public rights-of-way, such as Beekeeper Ln east of Corey Road, are named but not accepted.

How is a road problem reported to Malabar Public Works?

Through the service request form on the Malabar Public Works page, which covers road maintenance, drainage maintenance and overgrown shrubbery in the right-of-way, or by calling Town Hall at 321-727-7764 option 2. The Public Works Building at 1435 Centre Street is open weekdays 7:00 a.m. to 4:00 p.m.

Can a Malabar owner build a house on an unpaved, unaccepted road?

Only after providing for the road's improvement from the nearest accepted road through the far edge of the lot and dedicating right-of-way, under Malabar Code Sections 13-38 and 13-39, unless the Town Council grants a waiver.

Who pays for streetlights on Malabar Road and US 1?

Florida Power and Light maintains the lights, the Town of Malabar pays the electricity, and the Florida Department of Transportation reimburses the town for 17 state highway luminaires under the agreement placed on the May 18, 2026 council agenda as Resolution 06-2026.

What is the speed limit on Malabar residential streets?

Malabar Code Section 13-1 sets 20 miles per hour on residential streets in the RS-10, RS-15, RM-4, RM-6, RM-H and RLC zoning districts. Other posted limits apply on the state roads through town.
