Flood zones and floodplain rules — Malabar, Florida

Most of Malabar sits in FEMA zone X, but the town plan also maps zones A and AE, and Town Code Chapter 9 sets the permit and 50 percent rules.

Short answer: Most of Malabar is in FEMA zone X, outside the 1% and 0.2% annual chance floodplains, but the town plan also lists zones A, AE and X500 inside town limits, and town-funded studies found development within Flood Zone A in several basins. Malabar uses the FEMA flood map effective January 29, 2021, and Town Code Chapter 9 makes the building official the floodplain administrator, requires permits for development in flood hazard areas and applies the 50 percent substantial damage rule.

Is Malabar in a flood zone?

Most of Malabar is not in a high-risk flood zone: the town's Comprehensive Plan puts most of the town in FEMA zone X, an area of minimal flood hazard, while FEMA has also identified zones A, AE and X500 within the town (Town of Malabar).

The Malabar Conservation Element (December 2019) lists four FEMA zones inside town limits and defines zone X as land outside both the 1% and the 0.2% annual chance floodplains. Map FLU-4 in the same plan locates them, and the plan says land use as it relates to stormwater and natural drainage is regulated through the St Johns River Water Management District, while the Florida Building Code regulates construction as it relates to flood zones (page 3).

FEMA flood zones in the Town of Malabar (Comprehensive Plan, December 2019)
ZoneMeaning given in the Malabar plan
A1% annual chance flooding, no base flood elevations determined
AE1% annual chance flooding, base flood elevations determined
X5000.2% annual chance flooding, or shallow 1% flooding under 1 foot
XOutside the 1% and 0.2% floodplains, minimal flood hazard

The low ground follows the water. The Malabar Future Land Use Element puts town elevations between 0 and 30 feet, with most of the town at about 20 feet, and the lowest land along the coastline and the two creeks: Turkey Creek in the northwest corner and Goat Creek in the southeast corner. It adds that engineering studies paid for by Malabar found several basins and sub-basins where development sits within Flood Zone A (Future Land Use Element, page 8). The town Stormwater page says most Malabar water reaches the Indian River Lagoon through Turkey Creek, Goat Creek or direct discharge (Town of Malabar).

Which flood map does the Town of Malabar use?

Malabar regulates flooding from the flood insurance study for Brevard County, Florida and Incorporated Areas dated January 29, 2021, and its Flood Insurance Rate Maps, which Town Code Chapter 9 adopts by reference (Malabar Town Code).

Sec. 9-22 makes those maps the minimum basis for flood hazard areas in Malabar and keeps the studies and maps on file at the office of the town clerk (Sec. 9-22). Malabar Town Hall is at 2725 Malabar Road, and the town's Stormwater section links to a F.E.M.A. Flood Maps page (Town of Malabar). Last verified: October 13, 2026, on the Town of Malabar website.

FEMA's own record agrees on the date. The NFIP Community Status Book lists the Town of Malabar as community 120024 in Brevard County, participating in the National Flood Insurance Program, with a currently effective map date of 01/29/21 (FEMA Community Status Book). The same record shows how long Malabar has been mapped: a first flood hazard boundary map on March 1, 1974, a first flood insurance rate map on September 28, 1979, and entry into the regular program on 09/28/79.

Where is the Coastal High Hazard Area in Malabar?

Malabar's Coastal High Hazard Area is not on the Indian River waterfront but in a small riverine area at the very northwest corner of town, where about 10 homes on Briar Creek Boulevard and Hollow Brook Lane fall inside it (Town of Malabar).

Florida law defines the Coastal High Hazard Area as the land below the category 1 storm surge line from the SLOSH storm surge model, and the Malabar plan maps it on Map CST-2 (page 5). The plan says the current SLOSH model puts only a very small area of the Town of Malabar in that zone, more than two miles inland from the Indian River, at the confluence of two streams. Most of it is undeveloped; the homes on Briar Creek Boulevard and Hollow Brook Lane there are on public sewer and water (page 6).

Storm planning in Malabar leans on the county. The same element states that there are no emergency shelters located within the Town, so Malabar coordinates with Brevard County in getting evacuation information to residents at each hurricane threat level (page 6). The town's emergency preparedness FAQ points Malabar residents to a Brevard County Emergency Management GIS map to look up their evacuation zone, and says shelter openings are announced on the Brevard County Emergency Management website (Town of Malabar).

Who enforces floodplain rules in Malabar?

The Town of Malabar building official serves as the floodplain administrator and must approve any development wholly or partly inside a flood hazard area before work starts (Malabar Town Code, Chapter 9).

Town Code Chapter 9, the floodplain management ordinance adopted by Ord. No. 20-13 on November 16, 2020, replaced the flood damage prevention chapter Malabar had adopted on February 3, 2014 (Chapter 9 editor note). It covers far more than houses: filling and grading, utility work, manufactured homes, tanks, recreational vehicles, swimming pools and any other development in a flood hazard area (Sec. 9-2). One of its stated purposes is to meet the requirements of the National Flood Insurance Program for community participation, which is what keeps federal flood insurance available to Malabar property owners.

Sec. 9-40 requires an applicant to apply to the Malabar floodplain administrator, and the building official if applicable, before any development in a flood hazard area. Work that is not covered by the Florida Building Code gets a separate floodplain development permit under Sec. 9-41. A permit lapses if work is not commenced within one hundred eighty (180) days after its issuance, or if work stops for 180 days; extensions of up to 180 days must be requested in writing. Appeals of the floodplain administrator's decisions go to the Malabar board of adjustment, and from there to circuit court (Sec. 9-40 to 9-71). A building without documentation of the elevation of the lowest floor is presumed to be in violation until that documentation is provided (Sec. 9-80).

What is the 50 percent rule for flood-damaged homes in Malabar?

In Malabar, a building in a flood hazard area must be brought up to current flood construction rules when repairs or improvements cost 50 percent or more of its market value (Malabar Town Code, Chapter 9 definitions).

Malabar Town Code Chapter 9 defines substantial damage as damage of any origin where restoring the building to its before-damaged condition would equal or exceed fifty (50) percent of the market value before the damage occurred. Substantial improvement is any repair, reconstruction, addition or other improvement whose cost equals or exceeds fifty (50) percent of the market value before the work starts; once a structure has substantial damage, any repairs count as substantial improvement (Article II).

Sec. 9-33 sets the Malabar procedure. For each permit to improve or repair a building, the floodplain administrator must estimate the market value, or require the applicant to obtain an appraisal of the market value from a qualified independent appraiser, using the value before the damage for repairs; compare it with the cost of the work; document whether the work is substantial; and notify the applicant when the flood resistant construction requirements of the Florida Building Code and Chapter 9 apply (Sec. 9-33). The special flood hazard areas this rule turns on are the areas with a one (1) percent or greater chance of flooding in any given year, shown on FIRMs as zones A, AO, A1-A30, AE, A99, AH, V1-V30, VE or V (Article II).

What building rules apply in Malabar flood zones?

Malabar's flood construction rules come mainly from the Florida Building Code, with Town Code Chapter 9 adding standards for manufactured homes, recreational vehicles, septic systems, wells, fill and structures the building code exempts (Malabar Town Code, Chapter 9, Article III).

Manufactured homes placed, replaced or substantially improved in a Malabar flood hazard area must be elevated so the bottom of the frame meets the Florida Building Code, Residential Section R322.2 (Zone A) or Section R322.3 (Zone V). Recreational vehicles and park trailers may sit in a flood hazard area only if they are on the site for fewer than one hundred eighty (180) consecutive days or are fully licensed and ready for highway use; otherwise they are treated as manufactured homes (Sec. 9-344 and 9-350).

All development in Malabar's Coastal Area is served by a private well and septic system (Coastal Management Element, page 5), and Chapter 9 covers both. New and replacement on-site sewage systems must follow Chapter 64E-6, F.A.C. and ASCE 24 Chapter 7 to keep floodwater out, and wells must meet Chapter 62-532.500, F.A.C. Fill must stay stable during rapid rise and drawdown of floodwater, and other development must be anchored against flotation, with mechanical, plumbing and electrical systems above the design flood elevation or meeting ASCE 24 (Sec. 9-331 to 9-370). Subdivision plans in Malabar must show adequate drainage, with drainage paths around structures in zones AH and AO.

Does Malabar get a flood insurance discount?

No: FEMA's Community Status Book lists no Community Rating System class for the Town of Malabar, so Malabar policies carry no CRS discount, although flood insurance is available because the town participates in the NFIP (FEMA Community Status Book).

The Malabar plan states a different intention. The purpose statement of the Coastal Management Element (December 2019) says the town will continue to participate in the National Flood Insurance Program Community Rating System administered by FEMA (Coastal Management Element, page 1), and Conservation Element Objective 6-1.3 commits Malabar to protect the flood-carrying and flood storage capacity of the 100-year floodplain and to stay consistent with NFIP policies (Conservation Element, page 16). FEMA's record, refreshed August 25, 2026, shows no class rating, no discount inside or outside the special flood hazard area and no class effective date.

Day-to-day standing water is a drainage matter rather than a flood zone matter. The Town of Malabar drainage FAQ says swales should hold less than six inches of water 72 hours after the last rainfall in most residential areas, and asks residents to call Malabar Town Hall at (321)-727-7764 when a swale stays fuller than that (Town of Malabar).

Frequently asked questions

What flood zone is most of Malabar in?

Zone X. The Town of Malabar Conservation Element says most of the town is outside the 1% and 0.2% annual chance floodplains, an area of minimal flood hazard. Zones A, AE and X500 cover smaller areas, shown on Map FLU-4 of the town plan.

When did the current Malabar flood map take effect?

January 29, 2021. Malabar Town Code Sec. 9-22 adopts the Brevard County and Incorporated Areas flood insurance study and FIRM of that date, and FEMA lists 01/29/21 as the effective map for Malabar, community 120024.

Who is the floodplain administrator in Malabar?

The Town of Malabar building official, under Town Code Sec. 9-30. The Town Council can change that designation by resolution. Decisions can be appealed to the board of adjustment and then to circuit court.

Can flood insurance be bought in Malabar?

Yes. FEMA lists the Town of Malabar as participating in the National Flood Insurance Program with no sanction. The town has no Community Rating System class, so Malabar policies receive no CRS discount.

How long can an RV stay on a Malabar lot in a flood zone?

Fewer than 180 consecutive days, unless it stays fully licensed and ready for highway use on wheels with quick-disconnect utilities. Otherwise Malabar Town Code Chapter 9 treats it like a manufactured home, including elevation rules.
