When can the public speak at a Sebastian City Council meeting?
At a regular Sebastian City Council meeting the public may speak during Public Hearings, Unfinished Business, New Business and the Public Input item, and on Consent Agenda items only when a council member pulls one for discussion.
| Agenda section | Public input? |
|---|---|
| Proclamations, Awards and Brief Announcements | No, except people giving or accepting them |
| Consent Agenda | Only if a council member pulls an item |
| Committee Reports and Appointments | No, except members reporting and applicants interviewed |
| Public Hearings | Yes |
| Unfinished Business | Yes |
| New Business | Yes |
| Public Input (items not on the agenda) | Yes |
| City Council Matters and Charter Officer Matters | No |
Each Sebastian agenda marks the points where input is taken; if public input is not listed for an item, the audience may observe but may not speak unless invited, and the City Council may, by majority vote, invite an individual to provide input at another time (City of Sebastian Public Participation). At council workshops and special meetings, input is limited to the specific item being discussed.
The Public Input item near the end of a Sebastian agenda is the slot for subjects that appear nowhere else on it. The council will not debate issues during that portion of the meeting; members may direct staff to follow up or place an item on a future agenda. The city encourages residents to work with staff before meetings and hand in materials early. Last verified: October 10, 2026, on the City of Sebastian website.
How long can a speaker talk, and what rules apply at the podium?
Sebastian City Council meetings allow up to three minutes per speaker per agenda item, while Sebastian boards and committees allow up to five minutes unless the agenda says otherwise.
The three minute council limit comes from Ordinance No. O-24-21, which the City of Sebastian lists with Resolution No. R-24-02, the City Council Meeting and Workshop Procedures, and Code Section 2-168 for boards and committees as the governing documents; where the web page and those documents differ, the documents control (Public Participation). The presiding body may extend or end a speaker's time by majority vote, and quasi-judicial hearings may use different limits.
Order at the Sebastian podium follows a short list. A speaker talks only when recognized by the Chair, directs all comments to the Chair, and speaks immediately before the council begins deliberating on that item, not after deliberation has started unless invited back. Personal, impertinent or slanderous remarks, political campaigning, and applause or disruptive behavior are not permitted, and any ruling by the Chair may be appealed to the full body by a member.
Time limits have been debated in Sebastian for years. On March 3, 2010, Vero News reported that Mayor Richard Gillmor asked the council to consider limits on presentations from the public, and that Councilman Don Wright suggested 10 minutes as the general rule; the council did not vote on the matter then (Vero News).
What do Florida open meeting laws require of Sebastian's council?
Florida law makes every Sebastian City Council meeting where official acts are taken a public meeting, and gives residents a reasonable opportunity to be heard before the council decides a proposition.
Section 286.011, the Sunshine Law, declares such meetings public meetings open to the public at all times, requires reasonable notice of them, and requires minutes to be promptly recorded and open to inspection (Florida Statutes, s. 286.011). In Sebastian that notice and record keeping fall to the City Clerk, a Charter Officer responsible for noticing City Council meetings to its members and the public and keeping a journal of the meetings (City Clerk).
Section 286.0114 adds the right to speak. Members of the public shall be given a reasonable opportunity to be heard on a proposition before a board or commission, subject to the board's own rules (Florida Statutes, s. 286.0114). Those rules are limited to matters such as time limits, letting representatives of a group speak for a large crowd, and forms for signing up and stating support or opposition. The statute exempts ministerial acts such as approval of minutes and ceremonial proclamations, and quasi-judicial proceedings, which explains why the Sebastian agenda closes proclamations to comment and runs zoning cases under separate rules.
Speaking at the podium is not the only channel. The Sebastian City Council lists a shared council email and a mailing address at Sebastian City Hall, 1225 Main Street, for written comments, and its five members in October 2026 were Mayor Fred Jones, Vice Mayor Bob McPartlan and council members Christopher Nunn, Ed Dodd and Sherrie Matthews (City Council).
How do quasi-judicial hearings and appeals change public comment in Sebastian?
In Sebastian quasi-judicial hearings, such as rezonings, variances and special exceptions, comments must stay on the specific case and address the legal criteria, and appeals are decided on the existing record.
The City of Sebastian explains that speakers at a quasi-judicial hearing may be required to give testimony based on personal knowledge or evidence, and that communications with decision makers outside the hearing may be disclosed on the record. The Chair announces the rules at the start of each such hearing.
Appeals are narrower still. When the Sebastian City Council hears an appeal of a decision by a board such as the Planning and Zoning Commission, it reviews the record from the original hearing and may not consider new evidence, new testimony or new opinions; public comment is generally limited or not permitted except to clarify that record (City of Sebastian). The practical effect is that a neighbor who wants to be heard on a rezoning in the Sebastian Highlands has to speak at the Planning and Zoning Commission stage, because the council appeal will not reopen it.
Can residents comment on a Sebastian meeting by Zoom?
Yes: Sebastian meetings run as Zoom webinars, and remote participants may speak only during agenda items open to public input, after using the Zoom Raise Hand feature.
The Sebastian Public Participation page states that remote participation follows the same rules as in person participation, that the Chair or staff call on speakers in the order requests are received, and that the Zoom chat feature is not used for public comment and is not monitored. Speakers who have not raised a hand, or who try to speak outside the designated times, will not be permitted to speak.

The Agenda Center carries current agendas for the City Council, the Planning and Zoning Commission, the Natural Resources Board and other bodies, and points to the Public Records Resource Site for older agendas and minutes (Agenda Center). | Days | Replay times |
|---|---|
| Monday to Thursday | 1 AM and 9 AM |
| Friday | 1 PM and 7 PM |
| Saturday and Sunday | 1 AM, 7 AM, 1 PM and 7 PM |
According to the COStv Schedule, all meetings start replaying on the Friday after they are held and repeat until the following Friday, meetings from the same week replay in date order, and a regularly scheduled live meeting interrupts the replays.
Public comment can shape the record even when it does not carry the vote. Sebastian Daily reported on January 19, 2026 that most speakers during public comment pushed for closing Harrison Street at Riverview Park, yet the council voted 3-2 for Concept C, which keeps the street open with an extended speed table (Sebastian Daily).
