Who serves court papers on someone in Sebastian?

Court papers for a person found in Sebastian are served by the Indian River County Sheriff's Office Legal Process Unit, because Florida assigns service to the sheriff of the county where that person is found.

The rule comes from Section 48.021, Florida Statutes, which states that all process shall be served by the sheriff of the county where the person to be served is found. Sebastian lies within the Indian River County limits, so a summons for a defendant in the Sebastian Highlands, a subpoena for a witness on Indian River Drive or a writ aimed at a business on U.S. 1 all go to the same county office in Vero Beach. The Sebastian Police Department at 1201 Main Street is not the office the statute names for this work.

The Legal Process Unit sits in the sheriff's Judicial Services Division. Its own description lists serving summons, subpoenas, garnishments and domestic violence injunctions and conducting evictions. The unit serves process for governmental entities, private attorneys, and the general public as well as out of state and out of county sources, so a Sebastian resident filing a case without a lawyer uses the same counter as a Vero Beach law firm.

The county line matters. The Indian River County Clerk's small claims page tells filers serving a party who resides outside Indian River County to contact the Sheriff's Office or a private process server for that county to find out what is required for service.

What does the sheriff charge to serve papers in Indian River County?

The Indian River County Sheriff's Office charges $40.00 for each summons, subpoena, order or writ served on a Sebastian party, with $50 more for enforceable writs, and the fees are not refunded.

The sheriff's services and fees page sets out the schedule. A $40.00 fee and a service packet are required for each defendant when there are multiple defendants, so a Sebastian landlord or contractor suing two people pays $80 before anything happens. All enforceable writs except executions requiring seizure of persons or property add $50 to the $40 fee, which covers writs of possession and replevin. If a deputy is required after the first 30 minutes, a $35 per hour cash charge is required at the time of service. The same page states that all Sheriff's fees are nonrefundable per statute.

Those figures are not a local choice. Section 30.231, Florida Statutes fixes the fees every Florida sheriff charges in civil cases: $40 for each summons or writ, $40 for each witness subpoena, and, for executions, $40 for processing each writ and $50 for each levy. It adds $40 for advertisement of sale, $40 for each sale and $40 for each deed, bill of sale or satisfaction of judgment. The statute directs that these fees be paid monthly into the fine and forfeiture fund of the county, which for service in Sebastian is Indian River County.

The clerk adds a separate charge. Under Section 28.241, Florida Statutes, the clerk of court shall collect a service charge of $10 for issuing an original, a certified copy, or an electronic certified copy of a summons, assessed against the party seeking it. That fee is paid to the Indian River County Clerk, not the sheriff.

How does a Sebastian filer get papers to the Legal Process Unit?

A Sebastian filer delivers the clerk-issued papers, copies for each person, the best known address and the fee to the Legal Process Unit at the Indian River County Courthouse, 2000 16th Avenue, Vero Beach.

The Legal Process Unit page lists its mailing address as Attn: Legal Process Unit, 2000 16th Avenue #232, Vero Beach, FL 32960, with a phone line of (772) 978-6002 staffed Monday through Friday between 8:00 AM and 5:00 PM. The sheriff's main office address, 4055 41st Avenue, is separate from the courthouse unit's mailing address.

The paperwork for a Sebastian defendant follows Section 30.231(3). The party requesting service must furnish the original process, a certified copy or an electronic copy signed and certified by the clerk, plus sufficient copies for the people being served. The statute also requires the best known address where the person may be served, and it states that a failed attempt at the address provided does not excuse the sheriff from due diligence in locating the person.

Payment has its own rules. The Clerk's small claims page states that the $40.00 sheriff fee is separate from the Clerk's fee, must come with a self-addressed, stamped envelope, and cannot be paid by personal check; the sheriff takes a cashier's check, money order or business check. The sheriff fee page also links a Civil Process payment form online. The Clerk also keeps a Sebastian Office at 1921 U.S. Highway 1, open Monday, Wednesday and Friday from 8:30 am to 5 pm, phone (772) 226-1147, and its Civil Department, where small claims filing packages are available, is in Room 158 of the courthouse, (772) 226-3100.

How is a summons actually delivered in Sebastian?

A summons for a Sebastian defendant is delivered by handing a copy to that person, or by leaving it at his or her home with a resident who is at least 15 years old.

Section 48.031, Florida Statutes defines the method. Service of original process is made by delivering a copy of it to the person to be served with a copy of the complaint, or by leaving the copies at his or her usual place of abode with any person residing therein who is 15 years of age or older and informing the person of their contents. A household member aged 15 or older who lives at a Sebastian home can therefore accept papers for a parent, while a visitor who does not live there cannot.

Businesses get a separate rule. The statute allows service on an individual doing business as a sole proprietorship, such as a Sebastian shop owner, at his or her place of business, during regular business hours, by serving the person in charge of the business at the time of service if two attempts to serve the owner are made at the place of business.

Some jobs take longer than a knock on the door. The Indian River County sheriff notes that any extended civil standby may require an Extra Duty Deputy, scheduled with the Extra Duty coordinator at (772) 978-6126, and asks filers to check with Legal Process staff in advance. Separately, the sheriff's fee page sets a $35 per hour cash charge if a deputy is required after the first 30 minutes.

Can someone other than the sheriff serve papers in Sebastian?

Yes, for papers that start a civil case in Indian River County, a certified process server on the judicial circuit's approved list may serve a Sebastian defendant instead of a deputy.

Section 48.27, Florida Statutes states that the chief judge of each judicial circuit may establish an approved list of natural persons designated as certified process servers. Being on the list authorizes a server to serve initial nonenforceable civil process on a person found within the circuit where the process server is certified, and a Sebastian filer may select one or more of them. Section 48.021 separately lets the sheriff of each county keep a list of special process servers, each subject to annual recertification and reappointment by the sheriff, which in Sebastian's case is the Indian River County sheriff.

The cost trade is simple in Indian River County. The Clerk's small claims page states that a filer who uses the services of a private process server will not have to pay the Sheriff's Office for service. Enforceable papers are different: writs of possession, replevin and execution that require a seizure stay with the sheriff, which is why the Legal Process Unit, not a private server, carries out levies on Sebastian property.

What does the sheriff do with a writ of execution or levy?

With a writ of execution, the Indian River County Sheriff's Office seizes and auctions the specific property listed by the judgment creditor; it does not collect money owed on a Sebastian judgment.

The sheriff's writs and levies page states that the Sheriff has no authority to demand payment on judgments or liens and is required by law to levy upon and sell specifically described property to satisfy the execution issued. A creditor holding a judgment against a Sebastian debtor supplies the original writ of execution from the court that issued the judgment and written instructions for levy naming the property. Deposits come first: $2,000.00 for vehicles, boats and motorcycles, $3,750.00 for dump trucks and heavy equipment, and $1,200.00 or $1,750.00 for real estate, depending on the length of the legal description.

Proof of ownership is checked locally. For a boat kept at a Sebastian canal home or a truck registered to a Sebastian address, the page requires a printout from the Indian River County Tax Collector's Office; for real estate, a certified copy of the deed from the Clerk's Recording Office. Internet printouts are not accepted.

The sale is public. After the property is secured, the Notice of Sheriff's Sale is advertised for 4 consecutive weeks in the Press Journal, and a deputy conducts a public auction to the highest bidder for cash or cashier's checks in hand only, with no minimum bid, and a $500.00 liquidation fee applies. Full payoff by the Sebastian defendant before the auction cancels the sale.

One filing is not handled by this unit at all. The Legal Process Unit page directs Baker Act and Marchman Act ex parte petitions to the Family Services Division of the Clerk's Office, Suite 136 of the Indian River County Courthouse.
