Short answer: Building on a vacant lot in Sebastian takes a City of Sebastian building permit filed through MGO Connect or at City Hall, 1225 Main St. Most Sebastian Highlands lots are zoned RS-10, which requires at least 9,500 square feet, an 80 foot width and a house of 1,200 square feet or more. The house must connect to Indian River County Utilities sewer where available, sit 18 inches above the street crown and meet a 160 mph design wind speed.

What does it take to build a house on a vacant lot in Sebastian?
Building on a vacant Sebastian lot takes a zoning check under the Land Development Code, a utility plan, an engineered design to the city wind speeds, and a building permit from the City of Sebastian Building Department at 1225 Main St.
| Step | Rule that applies in Sebastian | Source |
|---|---|---|
| Confirm zoning and lot size | RS-10: minimum lot 9,500 sq ft, 80 ft wide, 100 ft deep | LDC Sec. 54-2-5.2.3 |
| Plan water and wastewater | Connect to Indian River County Utilities unless an exception applies | LDC Sec. 54-2-7.4 |
| Check for gopher tortoise burrows | Work within 25 ft of a burrow needs an FWC permit | FWC |
| Design for wind | 160 mph ultimate wind speed for a house (Risk Category II) | City of Sebastian |
| Set the floor height | At least 18 in. above the street crown and 6 ft above mean sea level | Code Sec. 26-1 |
| Apply and pay | MGO Connect portal; $1,055 for the first $100,000 of value | City fee schedule |
| Start work on time | Permit lapses if work does not start within six months | Code Sec. 26-85 |
Most empty lots in the city sit inside the Sebastian Highlands, the grid of quarter acre home sites laid out by General Development Corporation, and nearly all of that land carries the RS-10 single-family zoning district. The Sebastian Building Department reviews plans, issues the permit and inspects the work, while the Community Development side of City Hall answers zoning questions. Utility service comes from Indian River County, not the city, so a lot in Sebastian deals with two governments before the slab is poured.
Fees are a separate checklist. Indian River County and City of Sebastian impact fees are owed before the permit is released, alongside the city building permit fee described below. Last verified: October 10, 2026, on the City of Sebastian website.
What size house fits on a Sebastian Highlands lot?
On an RS-10 lot in the Sebastian Highlands, a house needs at least 1,200 square feet of living area, may cover 30 percent of the lot and may rise 25 feet.
Section 54-2-5.2.3 of the Sebastian Land Development Code says the RS-10 district exists for low-density residential development on lots of 10,000 square feet, though the minimum lot size is 9,500 square feet. A buildable RS-10 lot must be at least 80 feet wide and 100 feet deep. Setbacks are 25 feet from the front line, 20 feet on a secondary front of a corner lot, 10 feet on each side and 20 feet at the rear.
The same section caps building coverage at 30 percent and impervious surface, which counts the driveway and patio slabs, at 55 percent, and it requires at least 50 percent open space. Every new single-family house in RS-10 needs a minimum living area of 1,200 square feet, not counting porches, terraces and the garage. Sebastian also requires a garage or a carport on each house, with an interior clear dimension of at least ten feet by 20 feet; a carport triggers an enclosed storage room of at least 60 square feet built into the house.
Height is measured from a raised starting point. Under LDC Sec. 54-2-5.10, building height runs from the highest of the minimum floor elevation, the required fill grade, or the base flood elevation plus one foot as required by the Florida Building Code. That section also lets an owner build on a legally platted Sebastian lot of record that falls short of today's minimum size, unless the same owner holds the next lot and could correct the shortfall by combining them.
Can a Sebastian lot owner act as the builder?
Yes, Florida Statute 489.103 lets a Sebastian owner pull an owner/builder permit for a one or two family home built for the owner's own use, but the first application must be filed in person at City Hall.
The City of Sebastian Building Permits FAQ sets out the limits. The house must be for the owner's sole use or occupancy and may not be built for sale or lease. If an owner/builder house is sold or leased within 1 year of completion, state law presumes it was built for sale, and the unlicensed contractor rules apply. The owner must supervise the site, is responsible for every required inspection, and may hire only licensed contractors or direct employees on payroll with workers' compensation. Breaking the exemption is a first degree misdemeanor carrying up to 1 year in jail and a $1,000 fine.
Filing works differently for owner/builders. According to the city Online Permits page, owner/builder permits can use the MGO Connect customer portal, but the initial application must be made in person at the building department at 1225 Main St. in Sebastian. After that, payments, document uploads and inspection requests run through MGO Connect, and all inspections must be scheduled one day in advance.
The FAQ also lists the site work that needs a separate city permit before any house goes up: driveways, including auxiliary driveways and drainage culverts over the Sebastian swale, fill placement, grubbing, land clearing and tree removal. The Building Department number for permit questions is 772-589-5537.
Will a new Sebastian house use sewer or a septic tank?
A new house in Sebastian must connect to Indian River County Utilities sewer where it is available, and since January 1, 2024 state law bars new conventional septic systems in the lagoon plan areas that include Sebastian.
Section 54-2-7.3 of the Sebastian Land Development Code requires all new development to connect to the Indian River County Utilities water system, with exceptions such as a single-family house on a lot in a subdivision approved before the code took effect. Where no central water reaches the street, a private well permitted through the county health department must go in a side yard behind the front building line or in the rear yard.
Wastewater follows the same pattern in Section 54-2-7.4. On a Sebastian lot without sewer, the septic tank and drain field must sit in a front or side yard, at least five feet from every lot line and outside all easements. No septic tank may be placed within 75 feet of mean high water along the Indian River or the Sebastian River, which matters for the riverfront lots off Indian River Drive and the canal lots along the St. Sebastian River.
State law narrowed the septic option. Under Section 373.469, Florida Statutes, new onsite systems have been prohibited since January 1, 2024 in the Indian River Lagoon basin plan areas where central sewer is available, and where it is not, only enhanced nutrient-reducing systems or systems that cut nitrogen by at least 65 percent are authorized. Sewer lines are still being extended: Indian River County lists North Sebastian Phase 3, a 168 home septic-to-sewer project, in the design phase as of October 10, 2026.
How high must a new Sebastian house sit, and what wind speed applies?
A new Sebastian house floor must sit at least 18 inches above the crown of the street and at least six feet above mean sea level, and the structure must meet the city's 160 mph design wind speed.
Section 26-1 of the Sebastian Code of Ordinances sets the floor height for every new residence in the city at no less than 18 inches above the crown of the abutting improved street and no less than six feet above mean sea level, whichever is higher. Lots inside a FEMA flood zone also follow the city flood chapter, and the Land Development Code measures height from the base flood elevation plus one foot. Section 26-5 then limits fill: on a lot served by septic, fill may rise no more than one foot above the septic tank elevation set by the health department or the minimum floor elevation, whichever is greater.
Fill itself needs approval. Under LDC Sec. 54-2-7.15, no Sebastian lot may be filled without prior written approval of the city engineer, and fill on a lot with side or rear drainage swales must be sloped to send runoff into those swales. Incidental fill of up to 50 cubic yards a year, such as topsoil or driveway shell, is exempt only on developed single-family property, so a vacant lot gets no such pass.
Wind design comes from Ordinance O-12-08. The City of Sebastian adopted ultimate wind speeds of 150 mph for Risk Category I, 160 mph for Risk Category II, which covers an ordinary house, and 170 mph for Risk Categories III and IV. The Florida Building Code 2023, 8th Edition, took effect on December 31, 2023, and its wind maps apply alongside those city numbers.
What has to happen before a Sebastian lot is cleared?
Before a Sebastian lot is cleared, the owner needs city land clearing and tree permits and must keep all work at least 25 feet from any gopher tortoise burrow or hold an FWC relocation permit.
The Florida Fish and Wildlife Conservation Commission treats any clearing, grading, construction or equipment staging within 25 feet of a burrow as a disturbance that needs a relocation permit. A permit may not be needed when every bit of that work stays 25 feet away, and the same buffer applies on every vacant lot in the Sebastian Highlands.
The Highlands also carry a federal backstory. According to WQCS, Indian River County's Sebastian Area-wide Florida Scrub-jay Habitat Conservation Plan was approved in 2000 because of rapid growth in the Sebastian Highlands, and it allowed homebuilding to continue under an incidental take permit while requiring permanent conservation and habitat restoration on public land.
Neighbors notice cleared lots. In January 2023, Sebastian Daily reported that the Sebastian City Council held a special meeting on three lots near Roseland Road and CR 512 that were recently cleared to build homes, after residents raised safety concerns about driveways beside the turning lane on Roseland Road.
How much is the Sebastian building permit, and how long does it last?
The Sebastian building permit fee is based on construction value, $1,055 for the first $100,000 plus $5.50 per added thousand, and the permit lapses if work does not begin within six months.
| Total valuation | Permit fee |
|---|---|
| $3,000 and less | $90 plus $45 per added inspection |
| $3,000.01 to $50,000 | $90 plus $11.50 per added thousand |
| $50,000.01 to $100,000 | $630 plus $8.50 per added thousand |
| $100,000.01 to $500,000 | $1,055 plus $5.50 per added thousand |
| $500,000.01 and up | $3,255 plus $2.50 per added thousand |
The figures come from the City of Sebastian fee schedule. On a typical Highlands house valued at $300,000, the tier works out to $2,155 before plan review and impact fees.
Time limits are set in Code Sec. 26-85. A Sebastian permit becomes invalid unless work starts within six months after issuance, or if the work is abandoned for six months, and a job counts as active only when it passes an inspection within 180 days. No one may live in the house until the building official issues a certificate of occupancy.
The site has its own rules while the house goes up. Chapter 26 requires a portable toilet on every Sebastian construction site, kept out of the right of way and ten feet from any waterway, plus enclosed trash containers. Within 24 hours of a hurricane watch or warning, contractors must tie down loose materials and reopen blocked swales, and the fine reaches $1,000 per site.
Frequently asked questions
Can a mobile home be placed on a Sebastian Highlands lot?
The RS-10 district that covers most of the Sebastian Highlands lists single-family dwellings as its permitted residential use, and the Land Development Code handles manufactured housing in a separate section. The City of Sebastian Community Development staff at 1225 Main St. confirm what a specific lot allows.
Does a Sebastian owner/builder have to live in the house?
The house must be for the owner's own use or occupancy. Under Florida Statute 489.103, as explained by the City of Sebastian, selling or leasing it within one year of completion creates a legal presumption that it was built for sale, which voids the owner/builder exemption.
How close to the river can a septic tank go in Sebastian?
No closer than 75 feet to mean high water along the Indian River or the Sebastian River, under Section 54-2-7.4 of the Land Development Code. The tank must also be at least five feet from every lot line and outside easements, and new septic is barred where county sewer is available.
Where are permits for a new Sebastian house filed and tracked?
Through the MGO Connect customer portal run for the City of Sebastian, which handles applications, uploads, fee payments and inspection requests, or by email to the Building Department. Owner/builders file the first application in person at 1225 Main St., and every inspection must be booked one day ahead.
What happens to a Sebastian construction site when a hurricane watch is issued?
Section 26-8 of the Sebastian Code gives contractors 24 hours after a hurricane watch or warning to remove loose materials, secure partly built structures and restore drainage through swales. Violations can bring fines of up to $1,000 per site or suspension of a contractor license.
