Fireworks Rules — Sebastian, Florida

State law sets three fireworks holidays; Sebastian's Sec. 42-29 covers every other day, plus sales and the city's own show over the lagoon at Riverview Park.

Short answer: In Sebastian, state-approved sparklers and novelties such as snakes and party poppers are legal all year. Other fireworks may be used on January 1, July 4 and December 31 under section 791.08 of the Florida Statutes; on other days Sec. 42-29 of the Sebastian Code requires approval from the City of Sebastian Fire Prevention Office. A public display needs a written permit application at least 15 days ahead and the city's $100 display fee.

On which days can Sebastian residents use other fireworks?

Beyond approved sparklers and novelties, Florida law exempts personal fireworks use in Sebastian on three designated holidays in section 791.08: New Year's Day, the Fourth of July and New Year's Eve.

Seasonal retail sales of sparklersJune 20 through July 5, and December 10 through January 2Seasonal retailer period

Section 791.08 defines a designated holiday as New Year's Day, January 1; Independence Day, July 4; or New Year's Eve, December 31, and states that the chapter does not prohibit the use of fireworks solely and exclusively during a designated holiday (s. 791.08). The seasonal retail windows come from the definition of a seasonal retailer in section 791.01 (s. 791.01). The holiday rule dates from chapter 2020-11, Laws of Florida.

Homeowners' associations have a narrow say. Section 791.08 does not override a fireworks ban written into a legally recorded declaration of covenants of an association under chapter 720, but an association board may not adopt rules that take away a homeowner's right to use fireworks on a designated holiday (s. 791.08). For a Sebastian home under recorded association covenants, those covenants can narrow the holiday rule; a lot in the Sebastian Highlands without such covenants answers only to state law and the city code.

How does Sebastian's Sec. 42-29 fit with state law?

Section 42-29 of the Sebastian Code makes fireworks use in the city unlawful unless the City of Sebastian Fire Prevention Office approves it or the use is otherwise allowed by law, which is where the state holiday exemption fits.

The city rule, adopted by Ordinance O-19-06 on September 25, 2019, says it shall be unlawful for any person to possess, use or explode any fireworks in the city unless such use is approved and authorized by the City of Sebastian Fire Prevention Office or otherwise allowed by law (Sebastian Code, Sec. 42-29). Read with section 791.08, the city text and state law fit together on this reading: use on January 1, July 4 and December 31 is a use allowed by law, and use on any other day needs Fire Prevention Office approval. Violations of Sec. 42-29 are punishable under section 1-10 of the city code by up to 60 days in jail, a fine of up to $500.00, or both.

State law also limits how far a city can go. A note to section 791.07 quotes section 10(5) of chapter 2007-67, which says that after March 8, 2007 a municipality may not adopt an ordinance that directly prohibits or directly interferes with the right to purchase, sell, use or possess consumer fireworks (s. 791.07 and note). Section 791.08 in turn states that it does not supersede local regulation as provided in that same 2007 law (s. 791.08). The Sebastian code's own words, otherwise allowed by law, leave room for both.

Sales inside the city are tightly limited. Sec. 42-29 allows a wholesaler registered with the state fire marshal and the City of Sebastian to sell fireworks under chapter 791, but only on lands zoned commercial or industrial, from a permanent building protected by an automatic fire sprinkler system and a fire alarm system (Sebastian Code, Sec. 42-29). Tents and other temporary structures may be used for seasonal retail only with a special event permit from the Fire Prevention Office, and the Sebastian Police Chief or a designee may seize stock held in violation, at the business owner's expense.

What permits does a public fireworks display in Sebastian need?

A public fireworks display in Sebastian needs a municipal display permit and the city's $100 Public Fireworks Display (Pyrotechnics) fee, plus any Indian River County Fire Rescue standby unit fees.

The City of Sebastian Fire Safety Specialty Fee schedule lists Public Fireworks Display (Pyrotechnics) at a $100 flat fee and notes that additional fees may apply for an Exclusive or Non-Exclusive Fire Unit through IRC Fire Rescue (City of Sebastian fee schedule). The fire unit comes through Indian River County Fire Rescue rather than the city. The county Fire Prevention Bureau's permits page posts a Fireworks Permit Application and a Fire Unit Standby Request among its forms, under a fee structure created by Ordinance 2004-021 and Resolution 2004-071, adopted July 6, 2004 (Indian River County Fire Prevention Bureau).

State law sets the display rules. Section 791.02 lets a municipality adopt rules for permits for supervised public displays within its boundaries, requires that each display be handled by a competent operator approved by the chiefs of the police and fire departments, requires a written application at least 15 days in advance and makes permits non-transferable (s. 791.02). Section 791.012 applies NFPA 1123, the 2018 Code for Fireworks Display, to outdoor displays, while excluding displays on private residential property (s. 791.012). The city holds its own show: for the 4th of July Freedom Festival on July 4, 2026, the city calendar scheduled fireworks to begin at 9:00 PM from the twin piers over the Indian River Lagoon at Riverview Park, 600 U.S. Highway 1 (City of Sebastian calendar).

Why do fireworks matter for Indian River Lagoon wildlife near Sebastian?

Fireworks along the Sebastian waterfront reach nesting birds on the Indian River Lagoon, and Audubon groups urge residents to watch city shows rather than set off their own.

Vero News reported on July 2, 2026 that Audubon Florida warns fireworks near ocean beaches and lagoon shores can frighten nesting coastal birds, naming least terns, skimmers, Wilson's plovers, snowy plovers and American oystercatchers, and that debris can be mistaken for food by sea turtles (Vero News). The article reports that Audubon suggests attending municipal shows instead of deploying store-bought fireworks, and quotes Pelican Island Audubon Society chairman Dr. Richard Baker saying the fireworks done by the cities and counties should be enough for all to enjoy. Florida law has one bird-related exemption of its own: fireworks used solely to frighten birds from agricultural works and fish hatcheries are governed by Department of Agriculture and Consumer Services rules (s. 791.07).
