Variances — Palm Bay, Florida

Palm Bay sends small setback and dimension fixes to staff and larger ones to public hearings before two bodies.

Short answer: A Palm Bay zoning variance is relief from a Land Development Code standard when the lot itself causes an unnecessary hardship. Requests within 10 percent (new construction) or 20 percent (existing structures) can be an administrative variance decided by staff for $50.00. Larger requests are filed through the iMS Online Portal with the Land Development Division for $500.00 and go to the Planning and Zoning Board and then the Palm Bay City Council.

What is a zoning variance in Palm Bay?

A zoning variance in Palm Bay is permission from the Palm Bay City Council to depart from a Land Development Code standard when the property itself creates an unnecessary hardship.

Section 172.025 of the Palm Bay Land Development Code says the City Council hears petitions for variances where, owing to special conditions, enforcement of the land development regulations would result in unnecessary hardship (Palm Bay LDC section 172.025). The code ties that hardship to the land: it generally occurs when the physical characteristics of a lot mean it cannot be used for any permitted purpose, and it may come from the surroundings, shape or topography of that specific Palm Bay parcel.

Two limits in Section 172.025 close off common requests. A hardship cannot be self-imposed or the result of the owner's own action, and the establishment or expansion of a use otherwise prohibited shall not be allowed by variance. Section 172.026 describes the administrative route as relief from setbacks, floor area ratios, height limitations, lot coverage, yard requirements, parking and similar dimensional standards, and bars using it to change the use of a property (Palm Bay LDC section 172.026(A)).

The rules sit in Chapter 172 of the Palm Bay Land Development Code, adopted September 19, 2024. Last verified: October 12, 2026, on the City of Palm Bay website, using the Land Development forms page and the adopted Chapter 172 text.

Does a Palm Bay request need a hearing or only staff approval?

Small dimensional relief in Palm Bay goes to staff as an administrative variance for $50.00, while larger requests need a public hearing variance at $500.00 before two bodies.

Table 172-1 of the Palm Bay code classes a variance under Section 172.025 as quasi-judicial, with a pre-application meeting, Growth Management review, a Planning and Zoning Board hearing and a City Council decision. An administrative variance under Section 172.026 is administrative, reviewed by Growth Management with no board or Council hearing (Palm Bay LDC Table 172-1).

The size of the request sets the route. Under Section 172.026, administrative variances in conjunction with new construction are limited to ten percent of the dimensional requirement, and those for existing principal or accessory structures are limited to 20 percent of the applicable code section (Palm Bay LDC section 172.026). The Palm Bay Land Development forms page describes the hearing route as a variance of greater than 20 percent and the administrative route as less than 20 percent, so a new Palm Bay addition that misses a setback by more than ten percent still needs the hearing.

The fees in the table come from the Palm Bay Land Development forms page and match Exhibit A of Resolution 2025-34, enacted by the Palm Bay City Council at Meeting 2025-23 and effective October 1, 2025 (Palm Bay Resolution 2025-34). Both variance fees are charged following sufficiency review, and Section 172.011 says no fee is returned regardless of the city's determination (Palm Bay LDC section 172.011).

What goes into a Palm Bay variance application?

A Palm Bay variance application is filed through the iMS Online Portal with a boundary survey, a site plan marking the requested relief and a written answer to each review criterion.

Section 172.025(B) lists the core package for a hearing variance: a boundary survey; a site plan depicting existing and proposed development and highlighting the requested variance; a signed application; and a notarized disclosure statement by parties with at least five percent interest in the property (Palm Bay LDC section 172.025(B)). The applicant must also identify the particular code provision that blocks the project, the existing zoning, the special circumstances of the land, the particular hardship, and how far the rule would have to be varied (Palm Bay LDC section 172.025(B)(d)-(h)).

The Palm Bay Land Development forms page adds the hearing items. The 500-foot radius mailing package of nearby owners is requested from the Brevard County Information Technology Department at GISrequest@brevardfl.gov using the parcel's tax account number. Where a homeowners association covers the lot, the Land Development Division asks for correspondence showing the association's position. Staff then supplies a sign template so the applicant can post a meeting sign on the property under Section 51.07(C) of the Palm Bay Code of Ordinances.

An administrative variance needs less: an owner's authorization letter where someone else applies, a site plan drawn to scale showing the variance desired, a survey by a registered surveyor and a letter of intent. Pre-application meetings with Palm Bay staff are held every Tuesday between 1:30 pm and 3:45 pm, virtually via Teams, or in person in City Hall Annex Growth Management Conference Room 228 at 120 Malabar Road on request (City of Palm Bay Land Development Division).

Section 172.007 adds a gate before any of this. No application for development approval is processed or scheduled for hearings if the Palm Bay property has outstanding code violations as determined by the Code Compliance Division, unless the application is directly necessary to correct the violation (Palm Bay LDC section 172.007).

How do the Palm Bay variance hearings run?

A Palm Bay public hearing variance gets a staff recommendation, a public hearing before the Planning and Zoning Board, and a second public hearing and final vote by the Palm Bay City Council.

Section 172.025(C) sets the order. The City Manager or designee reviews the application against the applicant's response to the review criteria and forwards a recommendation to the Planning and Zoning Board, which holds a public hearing and may grant, deny or grant with conditions. The City Council then holds its own public hearing on the board's recommendation and may grant, deny or grant with conditions (Palm Bay LDC section 172.025(C)).

The Palm Bay Planning and Zoning Board has seven members appointed by Council and meets on the first Wednesday of each month at 6:00 p.m. in City Hall Council Chambers, 120 Malabar Road SE (City of Palm Bay Planning and Zoning Board). The board page notes that it considers quasi-judicial matters, and anyone using electronic media to address the board must give the file to staff by 2:00 p.m. on the meeting day. The Land Development Division at (321) 733-3042 assigns case numbers and meeting dates.

State law puts a clock on the process. For applications that require final action through a quasi-judicial hearing, Section 166.033, Florida Statutes, requires a decision within 180 days after the municipality has deemed the application complete, and every approval or denial must include written findings (Section 166.033, Florida Statutes). The same statute gives Palm Bay 30 days after receiving an application to review it for completeness.

What must a Palm Bay variance request prove?

Every Palm Bay hearing variance must show, criterion by criterion, that the problem is peculiar to the land, not caused by the applicant, and that the relief is the minimum needed.

Section 172.025(D) of the Palm Bay code lists the criteria and says all variance requests shall demonstrate the application of each criterion to the specific case (Palm Bay LDC section 172.025(D)). The first three require special conditions peculiar to the land, structure or building; that those conditions are not the result of actions of the applicant; and that literal enforcement would deprive the applicant of rights commonly enjoyed by other Palm Bay properties in the same zoning district.

The remaining Palm Bay criteria test the size and effect of the request: the variance must be the minimum variance necessary to make possible the reasonable use of the land, must not confer a special privilege, and must be in harmony with the general intent of the code without injury to surrounding properties (Palm Bay LDC section 172.025(D)(4)-(7)). A seventh path covers a reasonable disposition of a claim under the Bert J. Harris Private Property Rights Protection Act, based on a special master's recommendation or a court order.

Section 172.025 states that financial disadvantages or inconvenience to the applicant shall not constitute conclusive evidence of unnecessary and undue hardship, a line the Palm Bay Land Development forms page repeats. The same section lets the Palm Bay City Council grant variances under the Americans with Disabilities Act as reasonable accommodations for an applicant or a member of the household, and the forms page asks such applicants to cite the section of the act involved.

Administrative requests in Palm Bay face their own tests under Section 172.026(C): no more than two sides of the encroaching construction may be considered for a setback variance, no earlier setback variance may be changed again administratively, and the plan must show how water runoff from the encroaching area is handled (Palm Bay LDC section 172.026(C)). For existing work, a registered architect or engineer must certify that the encroaching construction complies, or can be made to comply, with the Florida Building Code.

What happens after a Palm Bay variance decision?

A Palm Bay variance can be granted with conditions, and a denial can be challenged either before the City Council or in court depending on who made the decision.

Section 172.025(C)(5) lets the Palm Bay approving body attach conditions, including time limits for the initiation of the variance and specific minimum or maximum limits to regular code requirements. For an administrative variance, Section 172.026 has the Palm Bay department mail a courtesy notice of the City Manager's decision to all owners whose property abuts the applicant's lot (Palm Bay LDC section 172.026(D)).

Appeals split by decision type under Section 172.014. A staff decision, such as an administrative variance denial, is appealed to the Palm Bay City Council within a reasonable time not to exceed 60 days by filing a notice of appeal, and the Council hears it within 30 days (Palm Bay LDC section 172.014). The appeal fee is $650.00 under Resolution 2025-34. A final City Council action on a hearing variance is appealed under the Florida Rules of Appellate Procedure.

One Palm Bay case shows the hearing route at work. The September 5, 2023 Planning and Zoning Board minutes list case V23-00006, River's Edge Mixed Use, filed for the Florida Institute of Technology, a variance to let three proposed parking garage buildings encroach 20 feet into the 20-foot front-yard setback for accessory structures on about 6.92 acres west of Dixie Highway NE near Anglers Drive NE (Palm Bay P&Z minutes, September 5, 2023). That case was continued to the October 4, 2023 board meeting, and the setback it sought relief from was set by Section 185.058(F)(8)(e) of the Palm Bay Code of Ordinances.

Frequently asked questions

How much does a variance cost in Palm Bay?

The Palm Bay Land Development Division charges a non-refundable $500.00 fee for a public hearing variance and $50.00 for an administrative variance, both after sufficiency review. Resolution 2025-34 lists the same amounts for fiscal year 2025-26, and Section 172.011 bars refunds whatever the outcome.

Can a variance allow a business that the zoning district does not permit in Palm Bay?

No. Section 172.025 of the Palm Bay Land Development Code says the establishment or expansion of a use otherwise prohibited shall not be allowed by variance. The Planning and Zoning Board page lists rezoning and conditional use requests among the matters on which the board holds hearings and makes recommendations to the City Council.

When does the Palm Bay Planning and Zoning Board meet?

Variance hearings before the Palm Bay Planning and Zoning Board are scheduled for the first Wednesday of the month, starting at 6:00 p.m., in City Hall Council Chambers on Malabar Road SE. Its seven members are appointed by the City Council, and the board hears quasi-judicial cases such as variances before they reach Council.

Does a code violation stop a Palm Bay variance application?

Usually. Section 172.007 says Palm Bay will not process or schedule an application for a property with outstanding violations found by the Code Compliance Division, unless the application is directly necessary to correct that violation. The City Manager or designee makes that determination.

How long can Palm Bay take to decide a hearing variance?

Section 166.033, Florida Statutes, gives a municipality such as Palm Bay 180 days after an application is deemed complete to approve, approve with conditions or deny an application requiring a quasi-judicial hearing. The decision must include written findings, and both sides may agree to an extension.
