Short answer: Sebastian allows a home-based business in any dwelling in a residential zone under Land Development Code Section 54-2-7.21, rewritten May 28, 2025. The business must stay secondary to the home, change nothing visible from the street, keep parking at residential levels and sell only from the house itself. Florida Statutes Section 559.955 allows up to two non-resident workers on site. A City of Sebastian business tax receipt is required, with a $50 home-business application fee.

Can a business be run from a home in Sebastian?
Yes: Sebastian Land Development Code Section 54-2-7.21 permits a home-based business in any dwelling unit in any residential zone, provided the business stays clearly incidental to living in the house.
| Topic | Rule | Source |
|---|---|---|
| Where allowed | Any dwelling unit, any area zoned for residential use | LDC 54-2-7.21(a), (b)(1) |
| Non-resident workers at the home | Up to 2 employees or independent contractors; remote staff unlimited | s. 559.955(3)(a) |
| Parking | No more than a similar home with no business; legal spaces only, not in the right-of-way, on a sidewalk or on unimproved ground | LDC 54-2-7.21(b)(2) |
| Outside appearance | No change indicating a business, other than permitted signage | LDC 54-2-7.21(b)(3) |
| City application fee | $50, plus the business tax for the classification | City BTR page |
| Typical review time | About 3 weeks | City BTR page |

The current text dates from Ordinance O-25-10, adopted May 28, 2025. It opens by authorizing home-based businesses in any dwelling unit and requiring that the use of the premises for the business shall be clearly incidental and subordinate to its use for residential purposes (Sebastian LDC Sec. 54-2-7.21). In practice that covers a bookkeeper in the Sebastian Highlands, an online shop shipping from a garage off Barber Street, or a contractor whose office is a spare bedroom, as long as the street sees a house and not a storefront.
Two layers of law apply. The city section sets the local standards, and Section 559.955 of the Florida Statutes, enacted in 2021, limits how far any Florida city can go. Sebastian's 2025 rewrite tracks the statute almost word for word, which is why the parking and heavy equipment language in the Sebastian code reads the same as the state law.
What limits apply to a home business in Sebastian?
A Sebastian home business may not change the outside look of the house, may not sell from an outbuilding and must keep parking and nuisances at residential levels.
Section 54-2-7.21(b) lists the standards. There shall be no change in the outside appearance of any structure on the premises to indicate a home-based business other than permissible signage, and no evidence of the business visible from outside the dwelling (LDC Sec. 54-2-7.21). A business may not conduct retail transactions at a structure other than the residential dwelling, so a detached shed or workshop on a Sebastian lot cannot become a sales counter, although incidental business activity on the property is allowed.
Vehicles get detailed treatment. Business parking may not be greater in volume than would normally be expected at a similar residence with no business, and work vehicles or trailers must sit in legal parking spaces that are not in the right-of-way, on or over a sidewalk, or on unimproved surfaces at the residence. Heavy equipment visible from the street or a neighbor is held to the same parking rule, and the Sebastian code defines it as commercial, industrial or agricultural vehicles, equipment or machinery. On a Sebastian Highlands lot with a grass swale, that means a work trailer belongs on the driveway, not the swale or the yard.
The last three standards address impacts. Business activity must comply with local and state rules on signage and on equipment or processes that create noise, vibration, heat, smoke, dust, glare, fumes or noxious odors, and with local, state and federal rules on corrosive, combustible or hazardous materials. Section 54-2-7.21(b)(8) adds that a Sebastian home-based business is subject to all applicable city business taxes in Chapter 30 of the Code of Ordinances, except where state or federal law preempts them.
How does Florida law limit what Sebastian can regulate?
Florida Statutes Section 559.955 bars Sebastian from licensing or regulating a qualifying home business differently from other businesses, beyond the standards the statute itself lists.
The statute, created by chapter 2021-202, provides that local governments may not enact or enforce any ordinance, regulation or policy to license or otherwise regulate a home-based business in violation of the section (Fla. Stat. s. 559.955). A qualifying business may operate in an area zoned for residential use and is only subject to business taxes under chapter 205 in the county and municipality where it is located, which for a Sebastian address means the City of Sebastian business tax.
The statute also defines who qualifies. The employees who work at the dwelling must live there, except that up to a total of two employees or independent contractors who do not reside at the residential dwelling may work at the business, and the business may have any number of remote employees. Local rules on noise, vibration, smoke, odors and hazardous materials may not be stricter than those for a residence with no business, so the Sebastian noise chapter applies to a home business exactly as it applies to the household next door.
Two points cut the other way. Any adversely affected current or prospective owner may challenge a local action that violates the section, and the prevailing party may recover reasonable attorney fees and costs. But the statute does not supersede a condominium declaration, a cooperative document or a homeowners association declaration of covenants, so a deed-restricted community in Sebastian can still enforce its own recorded limits on home businesses.
How is a Sebastian business tax receipt obtained for a home business?
A Sebastian home business applies to the Building Department at City Hall, 1225 Main Street, pays a $50 application fee plus the business tax, and usually waits about 3 weeks for approval.
The city's Local Business Tax Receipt page states that anyone engaging in any type of business within the city limits needs a City of Sebastian receipt. For a home-based application the Building Department asks for a floor plan marking the area where the business will be conducted, even if only the telephone is to be used, a recent photograph of the front of the home including the front yard and driveway, a letter of intent describing the business, and a copy of the fictitious name or corporation registration. The same page still states a cap of 20% of the living area; the May 2025 text of Section 54-2-7.21 contains no floor area limit.
Timing rules come from Chapter 30 of the Sebastian Code of Ordinances. Applications go to the director of the building department not less than two weeks before the business starts, and a profession regulated by the Department of Business and Professional Regulation must show an active state license. Receipts are sold beginning July 1, are due by September 30, and expire September 30 of the following year. A late renewal is charged 10% for October plus 5% for each later month, capped at 25% of the tax, and a new receipt issued between April 1 and September 30 costs half the annual tax. Payment at Sebastian City Hall may be made in cash, check, money order or credit card.
Which Sebastian home businesses are exempt from paying the business tax?
Since Ordinance O-25-09 of May 28, 2025, Sebastian waives the business tax for honorably discharged veterans and spouses, relocated military spouses, public assistance recipients and households below 130 percent of the poverty level.
Section 30-37(b) of the Sebastian Code lists the four groups: a veteran of the United States Armed Forces who has been honorably discharged, or the spouse or un-remarried surviving spouse of such a veteran; the spouse of an active-duty servicemember relocated to the city under a permanent change of station order; a person receiving public assistance as defined in state law; and a person whose household income is below 130 percent of the federal poverty level. The applicant signs a request for fee exemption under penalty of perjury and supplies documentation to the Building Department.
The waiver extends to some companies. If an exempt person owns a majority interest in a business with fewer than 100 employees, the business is exempt as well. The exemption covers the tax only: Section 30-37(a) states that when an exemption applies, a receipt must still be applied for and approved, so a home-based business run by a Sebastian veteran still files the floor plan, photograph and letter of intent. Charitable, religious, fraternal, youth, civic and service organizations need no receipt when proceeds are used exclusively for the organization.
What changes for homes outside Sebastian city limits?
Homes in unincorporated Roseland, Wabasso or Vero Lake Estates follow Indian River County rules: a $40 county business tax and a county Home Occupation Permit.
The Indian River County Tax Collector collects a local business tax from businesses located in the unincorporated areas of the county only, and states that the annual local business tax is $40.00 for all businesses (Indian River County Tax Collector). A home-based business in the unincorporated county must also obtain a Home Occupation Permit from the county Code Enforcement Department of Community Development at 1801 27th Street in Vero Beach. The Tax Collector directs businesses inside city limits to the City of Sebastian at (772) 589-5330.
Inside the city, zoning questions go to the Sebastian Community Development Department at 1225 Main Street, which administers the city's zoning and land development regulations and staffs the Planning and Zoning Commission and the Board of Adjustment. A Sebastian mailing address does not settle which government applies, since several neighborhoods with Sebastian addresses lie outside the city line, so the county or city business tax depends on the parcel itself.

Frequently asked questions
How many employees can work at a Sebastian home business?
Florida Statutes Section 559.955 allows up to two employees or independent contractors who do not live in the home to work there, plus any number of remote employees. Everyone else working at the Sebastian dwelling must live in it.
Does a Sebastian home business still face a 20% floor area limit?
The City of Sebastian business tax page still lists a 20% living area cap, but Land Development Code Section 54-2-7.21 as rewritten on May 28, 2025 contains no floor area limit. The Building Department at 1225 Main Street handles the application.
Can an HOA in Sebastian ban home businesses?
Florida Statutes Section 559.955 does not supersede condominium, cooperative or homeowners association declarations, so recorded deed restrictions in a Sebastian community can still limit home businesses even where city zoning allows them.
Do veterans pay the Sebastian business tax?
No. Since Ordinance O-25-09 of May 28, 2025, Sebastian Code Section 30-37 waives the tax for honorably discharged veterans and their spouses or un-remarried surviving spouses, though a receipt must still be applied for and approved.
Who issues home business permits in Roseland or Wabasso?
Roseland and Wabasso are unincorporated Indian River County, so the county Tax Collector collects a $40 annual business tax and county Code Enforcement in Vero Beach issues the Home Occupation Permit, not the City of Sebastian.
