Short answer: Cross Creek Lake Estates is a gated single-family subdivision in Sebastian, entered from Yearling Trail near Shakespeare Street and County Road 510. Indian River County records eight plats (Plat One to Plat Eight), and a Plat 9 and an Addition followed. A 38-lot Phase 3 on 19.44 acres in RS-10 zoning was recommended by the Planning and Zoning Commission, but on August 19, 2026 the Sebastian City Council continued it 5-0 over its second access.

Where is Cross Creek Lake Estates in Sebastian?
Cross Creek Lake Estates is a gated single-family subdivision in the City of Sebastian, entered from Yearling Trail, next to a parcel at Shakespeare Street and Yearling Trail about a quarter mile north of County Road 510.
The clearest description of the location comes from the 2021 annexation file for the land next to the existing neighborhood. Staff described a 19.58-acre parcel located at the SE intersection of Shakespeare St. and Yearling Trail, 1/4 mile north of CR510 (City of Sebastian council packet, October 13, 2021). The applicant's narrative added that the site abutted the Sebastian city limits on its north, east and west sides (annexation narrative).
Water shapes the southern boundary. The Sebastian River Improvement District canal known as R-12-E runs along that side, and the Phase 3 engineering sheet tells the contractor to clear the 25-foot SRID maintenance berm along the north side of the R-12-E canal (Phase 3 plan sheet, July 16, 2026 packet). The same sheet places the Phase 3 tract in Section 30, Township 31 South, Range 39 East, in flood zones X and AE on FEMA panel 12061C0113J dated January 26, 2023.
The neighbors matter for traffic. River Oaks, a separate future development, has proposed an extension of Shakespeare Street (P&Z minutes of July 16, 2026), and Sebastian's principal planner told the council that work south of Lighthouse Avenue would fall to the River Oaks developer rather than to the Cross Creek Lake Estates applicant (council minutes, August 19, 2026). City staff also shifted the planned emergency access during review so it lines up with Memorial Avenue, a two-way street (council minutes, page 16).
How many plats make up Cross Creek Lake Estates?
Indian River County's official subdivision list, revised January 10, 2025, records eight Cross Creek Lake Estates plats, numbered Plat One through Plat Eight, in county Plat Books 26 to 29 (Indian River County subdivision list, page 9).
| Plat | Plat book and page |
|---|---|
| Plat One | PB 26-70 |
| Plat Two | PB 26-74 |
| Plat Three | PB 26-86 |
| Plat Four | PB 26-88 |
| Plat Five | PB 27-31 |
| Plat Six | PB 28-18 |
| Plat Seven | PB 29-4 |
| Plat Eight | PB 29-52 |
The list comes from the Indian River County Property Appraiser's mapping department (list cover page). Each entry pairs the plat name with the book and page where the recorded plat can be pulled, which is the starting point for any title, survey or easement question about a lot in the Sebastian neighborhood. The plat book numbers for the Cross Creek Lake Estates plats run from 26 to 29.
The numbering has already moved past eight. The Sebastian Planning and Zoning Commission agenda for August 6, 2026 lists lots in Cross Creek Lake Estates Plat 9 within the Residential Single Family (RS-10) zoning district (P&Z agenda, August 6, 2026). The county list predates that plat, so the table above stops at Plat Eight.
What are the Cross Creek Lake Estates Addition and Phase 3?
Two newer pieces extend Cross Creek Lake Estates in Sebastian: the Addition, whose preliminary plat won approval in January 2024, and Phase 3, a 38-lot plan on 19.44 acres that still awaits a City Council decision.
For the Addition, the Sebastian City Council approved the preliminary plat by Resolution R-23-28 in January 2024, with a condition that a recreation fee-in-lieu payment for one acre of land be received before final platting. Resolution R-24-44, on the September 25, 2024 council agenda, proposed accepting a payment of $80,000 to be placed in trust for future public recreational needs of the city instead of a land dedication, and staff recommended approval (City of Sebastian staff report, September 25, 2024).
The 2021 annexation file for Ordinance O-21-15 describes a 19.58-acre parcel that abuts Cross Creek Lake Estates on the north and the Addition on the east (annexation application), while the 2026 Phase 3 staff report places the 19.44-acre Phase 3 site south of the original subdivision and west of the Addition. At its October 13, 2021 meeting the council was asked to hold first reading and, if approved, to set second reading and a public hearing for February 9, 2022 (O-21-15 transmittal). The applicant stated plans to develop the property as an extension of Cross Creek Lake Estates, extend and connect to public water and sewer, and give 25 feet of right-of-way on the west line for a future extension of Shakespeare Street to CR 510 (annexation narrative).
The Sebastian Phase 3 staff report puts the Cross Creek Lake Estates site under a Very Low Density Residential land use that allows up to 3 units per acre, with RS-10 zoning, and calculates a proposed density of 2.03 units per acre (P&Z staff report, July 16, 2026). The engineer of record told the council the lots run generally 80 feet by 130 feet (council minutes, August 19, 2026).
| Item | Proposed | Code requirement |
|---|---|---|
| Area and lots | 38 single-family lots on 19.44 acres | Very Low Density Residential, up to 3 units per acre |
| Density | 2.03 units per acre | 3 units per acre maximum |
| Typical lot | About 80 by 130 feet | 10,000 square feet minimum in RS-10 |
| Setbacks | 25 ft front, 10 ft side, 20 ft rear | Met without modification |
| Open space | 61 percent | 50 percent |
Who maintains the streets, tracts and utilities in Cross Creek Lake Estates?
Under the Phase 3 plans for Cross Creek Lake Estates in Sebastian, the streets, buffers, open space and stormwater tract go to the Cross Creek Estates homeowners association, while utility easements remain public.
The plan notes are specific. Subdivision right-of-way is to be dedicated to and maintained by the Cross Creek Estates HOA, all proposed utility easements remain public, and the landscape buffer, open space and stormwater management tracts go to the same association (Phase 3 plan sheet). The sheet lists a property owners association as the maintenance entity and fee simple as the form of ownership.
Street lighting follows a different model from most Sebastian subdivisions. The Planning and Zoning Commission heard that each lot owner will install a street light at the lot as a condition of the certificate of occupancy, under the declaration of covenants, instead of conventional subdivision lighting (P&Z minutes of July 16, 2026). Stormwater from Phase 3 is planned to collect in a wet retention pond that drains to the Sebastian River Improvement District canal (council minutes, August 19, 2026).
Recreation is handled by payment. The Phase 3 sheet cites Sebastian land development rule 54-4-19.11(H), which calls for 0.1 acre per dwelling unit, so 38 units produce a 0.38-acre requirement, and it states that public recreation will be paid in lieu (Phase 3 plan sheet).
Sewer in this part of Sebastian belongs to Indian River County. A septic-to-sewer feasibility study in the packet for the council's October 12, 2026 special meeting lists two lift stations named Cross Creek North, numbers 1047 and 1048, both owned by the county and installed in 2006 (feasibility study, page 23). The agenda lists it as a presentation from the Indian River County Department of Utility Services and its consultant AtkinsRealis (special meeting agenda, October 12, 2026).
Why did the Sebastian City Council delay the Phase 3 vote?
On August 19, 2026, the Sebastian City Council voted 5-0 to continue Resolution R-26-30, the Cross Creek Lake Estates Phase 3 preliminary plat, to a date uncertain over whether its second entrance met the code.
The Planning and Zoning Commission had recommended approval 7-0 on July 16, 2026, adding a condition requiring a gated access at the secondary access point (P&Z minutes, page 8). The plan relies on Yearling Trail through the existing subdivision as the primary access. Until River Oaks extends Shakespeare Street, an EMS-only stabilized access with sod cover would serve fire and rescue vehicles, and the new phase would not be gated apart from the rest of the neighborhood, although overall community gating stays in place (P&Z minutes, page 5).
Council members questioned that arrangement. Council Member Dodd said the city's code requires two publicly accessible points of ingress and egress for subdivisions greater than 24 units and that an emergency-only route does not satisfy it (council minutes, page 15). Council Member Matthews recalled that when Cross Creek Lake Estates was first proposed as a single phase of more than 60 homes, a permanent secondary entry and exit was required (council minutes, page 16).
The minutes of that meeting were placed for approval on the consent agenda of the September 9, 2026 Sebastian City Council meeting (council agenda, September 9, 2026). No later council action on R-26-30 appears in the city documents reviewed for this page. Regular City Council meetings are held in City Council Chambers, 1225 Main Street (council agenda, September 9, 2026). Last verified: October 12, 2026, on the City of Sebastian website.
Frequently asked questions
Is Cross Creek Lake Estates inside the City of Sebastian?
Yes. The neighborhood and its newer phases are reviewed by the Sebastian Planning and Zoning Commission and City Council, and the 19.58-acre parcel at Shakespeare Street and Yearling Trail was the subject of annexation Ordinance O-21-15, set for first reading on October 13, 2021 with a public hearing set for February 9, 2022.
What zoning applies in Cross Creek Lake Estates?
The newer Sebastian phases carry Residential Single Family (RS-10) zoning under a Very Low Density Residential land use of up to 3 units per acre. RS-10 sets a 10,000 square foot minimum lot, and Phase 3 lots run about 80 by 130 feet.
Are the Cross Creek Lake Estates streets public?
Not under the Phase 3 plans. The Sebastian plan sheet dedicates the subdivision right-of-way, buffers, open space and stormwater tract to the Cross Creek Estates HOA for maintenance, while all proposed utility easements remain public.
Has the Sebastian City Council approved Phase 3?
Not as of the documents reviewed through October 12, 2026. On August 19, 2026 the council voted 5-0 to continue Resolution R-26-30 to a date uncertain after debating whether an emergency-only access off the future Shakespeare Street alignment meets the code.
Who provides sewer service in Cross Creek Lake Estates?
Indian River County. The Sebastian septic-to-sewer feasibility study lists two Cross Creek North lift stations as county-owned and installed in 2006, and the 2021 annexation plan called for connecting the added land to public water and sewer.
