Business tax receipts — Brevard County, Florida

Brevard County taxes every business location, inside city limits or out: a $37 receipt from the Tax Collector, renewed by September 30, on top of any Palm Bay or Melbourne city receipt.

Short answer: Brevard County levies its own business tax on every business location in the county, inside or outside city limits, so a business in Palm Bay or Melbourne gets a city receipt first and then the county receipt from the Brevard County Tax Collector. The county receipt costs $37.00 a year, and new applications go to the Tax Collector's office at 400 South Street in Titusville or online. Receipts renew from July 1, expire September 30 and turn delinquent October 1.

Who needs a Brevard County business tax receipt?

Every business location in Brevard County, from a storefront in Viera to a home office in Palm Bay, needs a county receipt from the Brevard County Tax Collector, inside or outside city limits.

The rule comes from the county's own ordinance. The Tax Collector's business tax FAQ states that any legal entity engaged in or managing any business in the incorporated or unincorporated areas of Brevard County requires a Business Tax Receipt, issued under Chapter 102, Article II of the Brevard County Code as authorized by Chapter 205, Florida Statutes. The Tax Collector's Business Tax Receipts page adds that the local business tax is levied by Brevard County and municipalities, and that the Tax Collector collects the local business tax and issues the receipts.

Receipts follow locations and professionals rather than owners. A receipt is required for each location conducting business and for each person subject to professional classifications (Brevard County Tax Collector). The county code counts more places as a business location than a storefront: its definition reaches any location in which a person stores equipment or inventory, and any separate place where vehicles used in the business are regularly parked (Brevard County Code, Chapter 102). A contractor with an office on U.S. 1 in Melbourne and a separate equipment yard in Palm Bay is therefore looking at two county locations.

The receipt is a tax, not an approval. The Tax Collector warns that issuing a Brevard County receipt does not confirm that the activity on the property complies with local zoning, or that the premises meet building occupancy or life safety requirements, and that other permits, licenses or approvals may be needed. Receipts are non-refundable at the Tax Collector's office, so the zoning and licensing checks come before the application (Business Tax Receipts).

How much does the Brevard County receipt cost?

The Brevard County Tax Collector charges a flat $37.00 a year for each county receipt, the rate fixed in section 102-66 of the county code (Brevard County Code).

The ordinance reads: for each license required by this article, the business tax receipt rate is $37.00, and a single account classified in more than one section still pays no more than $37.00. The Tax Collector's FAQ describes the bill as $37.00 plus any penalties per year the business was open in Brevard County at the location on the application, and notes that depending on the type of business and the location there may also be a Hazardous Waste surcharge or a Fire Prevention fee (Tax Collector FAQ).

Some owners pay nothing toward the $37. The Tax Collector's renewal instructions list statutory exemptions for persons 65 years of age or older, widows with minor dependents, honorably discharged veterans or their spouse or unremarried surviving spouse, the spouse of an active duty service member who relocated to Brevard on a permanent change of station order, persons receiving public assistance, and any person whose household income is below 130% of the federal poverty level. The online application asks whether the applicant qualifies, and an affidavit with supporting documents proves it. The Tax Collector notes that this exemption only applies to the $37 annual receipt fee, so the receipt itself and its prerequisites still apply (Brevard County Tax Collector).

Selling off stock carries its own charge. State law (F.S. 559.20) requires a Going Out of Business permit for any liquidation or fire sale, and in Brevard County those permits are only issued at the Tax Collector's Main Office for $50.00, with the proposed advertising, the current county receipt and an inventory attached, and all tangible personal property and real estate taxes paid first (Business Tax Receipts).

How do Palm Bay and Melbourne businesses get both receipts?

A business inside Palm Bay or Melbourne needs both a city receipt and the Brevard County receipt from the Tax Collector, and Palm Bay sends owners to the county once its city receipt is issued (City of Palm Bay; City of Melbourne).

The City of Palm Bay spells out the order on its Business Tax Receipts page. Once the city receipt is issued, the business owner is directed to contact the Brevard County Tax Office at 400 South Street, 6th Floor, Titusville, FL 32780, or to apply online. Palm Bay asks applicants to allow 10 to 14 business days for processing, requires anyone licensed by the State of Florida or certified by Brevard County to attach copies of those licenses, and has required a copy of the Fictitious Name registration from every business using a DBA since July 1, 2017.

Melbourne says the same thing from the other side. The City of Melbourne Business Tax Receipts page states that Brevard County requires any business operating within the City of Melbourne to have a County Business Tax Receipt, and lists (321) 255-4453 for county questions. Melbourne's own receipt starts with a $25 nonrefundable application fee credited to the first year, and its professional rate starts at $100 for one professional. Melbourne also tells applicants to contact the Brevard County Property Appraiser's Office to confirm that the planned business location is within Melbourne city limits.

Outside city limits there is no city receipt, but there are county checks. For a business in an unincorporated area, the Tax Collector lists the offices to call before applying: Brevard County Zoning at (321) 633-2070, Environmental Health Services at (321) 633-2100, Brevard County Development Services at (321) 633-2072, the Office of Natural Resource Management at (321) 633-2017 for hazardous material disposal, and Brevard County Contractor Licensing and Certification at (321) 633-2058 for county trade licenses. For a business inside any municipality, the Tax Collector's instruction is simply to contact the municipality (Brevard County Tax Collector).

Two state prerequisites travel with the application to the Brevard County Tax Collector. Under section 205.194, Florida Statutes, a profession regulated by the Department of Business and Professional Regulation, the Florida Supreme Court or another state board must show a copy of the professional license before the Brevard County receipt is issued, uploaded online or photocopied for a mail renewal. A business name other than the owner's legal name must be registered as a fictitious name with the Florida Division of Corporations at (850) 245-6058 (Business Tax Receipts).

Where are county receipts applied for and renewed?

New county applications go to the Tax Collector's Titusville office at 400 South Street, 6th Floor, or online through BTExpress, and renewals are also taken at the branches in Viera, Palm Bay, Merritt Island and Titusville (Brevard County Tax Collector).

The Tax Collector's contact page separates applications from renewals. It shows the Titusville GCN office at 400 South Street, 6th Floor, open 8:30 AM to 5:00 PM on weekdays, handling real estate taxes and business tax applications and renewals, while each branch lists business tax renewals only. Online, the BTExpress Portal takes applications for a changed location or ownership, with a transfer fee of $3.70.

South Brevard has three branches on the list, each marked South Brevard Co. and each open 9:00 AM to 5:00 PM on weekdays for business tax renewals: Viera at 2725 Judge Fran Jamieson Way, Melbourne at 1515 Sarno Road and Palm Bay at 450 Cogan Drive SE. The Titusville GCN office remains the one in-person counter that lists new business tax applications (Tax Collector contact page).

Phone lines split by end of the county: 321-264-6969 for North County and 321-633-2199 for South County, with a dedicated business tax fax at 321-264-6792 (Tax Collector contact page). The Tax Collector's business tax page lists the same two numbers for receipt questions (Business Tax Receipts).

When does the receipt renew, and what does a late or missing receipt cost?

Brevard County receipts renew from July 1, are due by September 30 and become delinquent on October 1, when a 10 percent penalty for October applies (Brevard County Tax Collector; section 205.053, Florida Statutes).

The penalty schedule is state law, which the county code repeats. Section 205.053, Florida Statutes adds a delinquency penalty of 10 percent for the month of October, plus an additional 5 percent penalty for each subsequent month of delinquency until paid, and caps the total at 25 percent of the business tax. When September 30 falls on a weekend or holiday, the tax is due on the first working day after it. Brevard County Code section 102-47 sets the same delinquency penalties for county receipts (Brevard County Code, sec. 102-47).

Operating with no receipt at all costs more than renewing late. Anyone who engages in or manages a business without first obtaining a required local receipt is subject to a penalty of 25 percent of the tax due under section 205.053. A business that still has not paid within 150 days after the initial notice faces civil actions and penalties, including court costs, reasonable attorney fees, collection costs and a penalty up to $250.00, under section 102-47 of the Brevard County Code.

Changes have a 30-day clock. The Tax Collector asks for an online application within 30 days for any change to the account, whether location, ownership, mailing address, name or the nature of the business. A receipt not transferred within 30 days leaves the business subject to the same penalties as doing business without a receipt, plus the full amount due for each classification; a sale to a new owner needs the bill of sale (Business Tax Receipts). A closure or sale is reported in writing to BusTax@brevardtc.com with the date of closure or sale and the account number, and a mailing-only change, with the business still at the same Brevard address, goes to the same address with the account number and the statement that the business has not moved (Tax Collector renewal instructions).
