Special event permits — Sebastian, Florida

Fifty people is a park event, three hundred and one is a City Council decision, and a shopping plaza lot gets six events a year.

Short answer: Sebastian sorts events by crowd size and location. A planned event at a city park expected to draw 50 to 300 people needs a park event permit from the city manager, and one expected to draw more than 300 needs a special event permit from the Sebastian City Council under Code Section 74-7. Events on private property need a temporary use permit, filed at least 21 days ahead, for up to six events a year per site.

Which permit does an event in Sebastian need?

An event in Sebastian needs a park event permit from the city manager for 50 to 300 people on city park land, a City Council special event permit above 300, or a temporary use permit on private property.

The dividing line on city land is the expected crowd. Section 74-1 of the Sebastian Code of Ordinances defines a park event as a planned or organized event, other than a city-sponsored event, at which the city manager reasonably believes between 50 and 300 persons will attend, and a special event as the same kind of gathering where more than 300 persons are expected. Neither definition covers the Community Center or the Yacht Club, which are enclosed public-use facilities booked under their own permit.

Private land follows the Land Development Code instead. Section 54-2-3.2 of the Sebastian Land Development Code lets the city manager or a designee issue a temporary use permit for transient merchants and special events held on privately owned property, after review by the police chief, building official and fire marshal. City-sponsored events, such as the July 4 Freedom Fest parade on the Sebastian waterfront, run under the city's own authority and are outside both systems.

How does the Sebastian City Council approve a large park event?

An organizer files a written special event application with the Sebastian recreation department, and the City Council approves, conditions or denies it, with the council decision final.

Section 74-7 of the Sebastian Code sets the process: no person shall conduct a special event without the prior approval of the city council, and the application goes to the recreation department on forms promulgated by the city manager (Code Sec. 74-7). The permit fee and the conditions of approval are set by council resolution rather than written into the Code. For the smaller park event tier, Section 74-6 puts the same written application in front of the city manager instead of the council.

The standard for denial is written into the Code. The council shall deny an application if the special event will unreasonably conflict with public policy or if adequate measures cannot be taken by the applicant to protect the public health, safety and welfare. A decision to deny, or to grant with conditions, is final under Section 74-7(b), so there is no administrative appeal of a council ruling on a Riverview Park festival application.

Riverview Park is where most of these applications point. The city calls the park at 600 U.S. Highway 1, at the corner of C.R. 512/Sebastian Boulevard on the Indian River, the primary event and gathering point for the City of Sebastian, and lists the Clam Bake Festival, the Sebastian Fine Arts and Music Event and Shrimpfest and Craft Brew Hullabaloo among its annual events (Riverview Park facility page). The Parks and Recreation Department names Special Event Organization and Assistance among its services (City of Sebastian Parks and Recreation).

What does a Sebastian temporary use permit on private property require?

A Sebastian temporary use permit allows up to six events per calendar year per host site, filed at least 21 days ahead and limited to seven consecutive days per event.

The Land Development Code lists the kinds of events covered: outdoor sales, grand openings (only one per business), concerts, festivals, fairs, fundraisers, seasonal lots such as Christmas trees and pumpkin patches, and races or fishing tournaments (LDC Sec. 54-2-3.2). The site must be an improved lot within a non-residential or public service district, so a church lot or a shopping plaza on U.S. 1 qualifies while a yard in the Sebastian Highlands does not. The applicant must own the site or have written authorization from the owner.

Physical limits at a Sebastian host site are specific. Only temporary structures may be used, and shade canopies without sides smaller than 12 feet by 12 feet are approved; larger tents need a current flame retardant certificate, must be placed where the fire marshal approves, and must be inspected before the public occupies them. Tents should be at least four feet apart, temporary power needs Building Department approval, and the event may use no more than 30% of the host site's required parking stalls unless more parking is documented. No temporary use may operate in a public right-of-way, and events requesting road closures require a certified Maintenance of Traffic plan and approval by the Sebastian City Council. The police chief may require extra crowd control and security at the applicant's expense based on the size of the event.

Timing rules sit in Sections 54-2-3.3 and 54-2-3.4. Special events shall be in operation not more than seven consecutive days per event on any given site, and applications must be submitted no later than 21 days prior to the scheduled event, with an expedited processing fee set by resolution for late filings. Fees may not be waived. Within seven days after the permit expires, everything related to the event must be removed. A city manager decision may be appealed to the Sebastian City Council, and the appeal must be filed within five days.

What fire and police costs come with a Sebastian event?

Sebastian's Building Department charges no fire fee for a small one-day event and $60 for recurring or large events, while each Sebastian Police extra-duty officer costs $60 per hour with a 3-hour minimum.

Special Event (Recurring)$60Good for 120 days, up to 6 per year, may include electrical and cooking

Extra-duty police officer$60 per hour ($65 holiday)3-hour minimum, five days notice, paid in advance
Extra-duty police supervisor$70 per hour ($75 holiday)Plus $3 vehicle fee

The fire schedule comes from the city's Fire Safety Specialty Fee page. A small special event is defined as one day with no electrical, no cooking and fewer than 25 sites, with a maximum tent size of 12 by 12 feet, and it carries no fee. A recurring permit costs $60 and is good for 120 days and up to 6 events per year; every other special event is a $60 large event. A public fireworks display costs $100, and additional fees may apply for an exclusive or non-exclusive fire unit through Indian River County Fire Rescue. Chapter 42 of the Sebastian Code has the city conduct fire safety inspections for special events and site plans through a certified fire safety inspector.

Police coverage is booked separately. The Sebastian Police Department lets uniformed officers work extra-duty details for special events, traffic control or security, coordinated through the Detail Kommander system. A minimum of five days advance notice is required, payment is due in advance, and cancelling with less than 24 hours notice is billed at three hours per officer. Card payments add a 9% administrative fee and ACH payments 8%.

Which alcohol, food truck and park conduct rules apply to Sebastian events?

Alcohol in a Sebastian park is allowed only at a city-sponsored event or under a city permit, and a nonprofit selling drinks also needs a Florida temporary permit of up to 3 days.

Section 74-4(7) of the Sebastian Code bars possessing, consuming or serving alcoholic beverages in a recreation facility unless allowed in conjunction with a city sponsored event or as authorized by a city permit. At the state level, Section 561.422 of the Florida Statutes lets the Division of Alcoholic Beverages and Tobacco issue a permit to a bona fide nonprofit civic or charitable organization for a fee of $25 per permit, for a period not to exceed 3 days, and an organization may receive no more than 12 such permits per calendar year. The state application requires a local building and zoning permit, which in Sebastian means the city event approval.

Food trucks at Sebastian events follow the mobile food rules in Section 54-2-3.6 of the Land Development Code. Trucks working a city-sanctioned event or an event on city-owned property follow the standards set by the event coordinator and the city's leisure services department, plus state licensing from the Department of Business and Professional Regulation, the Department of Health or the Department of Agriculture and Consumer Services. On private property, more than two trucks at one location is allowed only as part of an approved temporary use permit, and alcohol sales at a private temporary use are prohibited unless the host site holds a current alcohol license.

Park conduct rules still apply during an event. Section 74-4 prohibits intentionally releasing balloons and other inflated objects in open-air city parks, a rule added by Ordinance O-24-20 on November 20, 2024, and limits sound systems played so loud they unreasonably interfere with others' use of the facility. Concessions, sales and solicitation in a Sebastian park require written prior approval of the city manager. Violations of Section 74-4 are punishable by a fine of up to $500.

Which Sebastian events does the city run itself?

The City of Sebastian ran ten signature events in fiscal year 2025-2026, most at Riverview Park, and these city-sponsored events need no outside permit.

The city's 2025-2026 signature events list ran from Sebastian Kids Fest at Riverview Park on October 4, 2025, through a Halloween costume contest, citywide holiday light displays, the Christmas Parade on the Sebastian waterfront on December 6, 2025, an Easter egg hunt and movie night on April 3, 2026 and Earth Day on April 18, 2026. Summer brought the Summer Kickoff Concert on June 5, 2026 and the July 4 Freedom Fest parade and fireworks, and the year closed with Touch and Tour at the Sebastian City Hall campus on September 12, 2026.

Those dates shape private planning. A community group seeking a Sebastian City Council special event permit for Riverview Park competes for weekends with the city calendar, and the council's twice-monthly meeting schedule makes an early filing practical. Events planned by outside groups, from fishing tournaments to the large riverfront festivals, use the permits described above.
