Short answer: Yes. Every business operating within Town of Malabar limits, including a home business, needs a Malabar business tax receipt before it starts, applied for and renewed through the town portal. Receipts are due on or before October 1 each year; a new business starting after April 1 pays half the fee, and late renewals add 10 percent in October rising to a 25 percent cap. Fees come from the Chapter 14 schedule, with a home based business at $50.

Does a business in Malabar need a business tax receipt?
Yes: the Town of Malabar requires every business operating within town limits to hold a business tax receipt before it conducts any business activity, and receipts are issued for one year at a time (Town of Malabar).
The rule sits in Chapter 14, Article II of the Malabar Town Code, adopted as Ordinance 08-01 in March 2008 to replace the older occupational license tax. It levies the fee on anyone who keeps a business location or branch office in Malabar and on others who transact business or practice a profession in interstate commerce where Section 8 of Article 1 of the U.S. Constitution does not prohibit the fee, and it requires a separate receipt for each place of business, even on the same premises (Malabar Town Code).
Advertising counts. Section 14-43 treats a sign, newspaper, magazine, telephone listing or other public notice as evidence that a business is operating in Malabar (Malabar Town Code). The Malabar FAQ confirms that a home business needs a receipt, quoting Article II directly (Town of Malabar FAQ).
A receipt is a tax, not a land use approval. Section 14-37 says all businesses remain subject to Malabar zoning, and Section 14-48 says the appearance of a use in the fee schedule is no evidence that the use is allowed in any Malabar zoning district (Malabar Town Code).
Exemptions are listed in Section 14-30, and even an exempt business must still apply. Veterans who are at least 10 percent disabled are exempt up to $50, Florida farmers selling produce from their own farm need no receipt, and charitable, religious, fraternal, youth, civic and service groups using the proceeds for the organization are exempt (Malabar Town Code). The town posts a separate BTR Exemption Application (Town of Malabar).
How is a Malabar business tax receipt applied for and renewed?
New Malabar receipts start in the town's online portal, where the BTR Application panel offers a Home BTR or a Commercial BTR form, and Town of Malabar staff review it for completeness before requesting payment by email or telephone (Town of Malabar).
Renewals use the same Malabar portal. The holder scrolls to the fourth panel, Search Existing BTRs, searches by BTR number or business address and pays with Submit Payment; from October 1, 2026 a convenience fee for credit and debit cards is charged at 3.5% or $2.00, whichever is higher (Town of Malabar). Questions go to Town Hall at 321-727-7764, the office at 2725 Malabar Road (Town of Malabar).
The receipt is a Town Clerk/Treasurer function. That office at Malabar Town Hall lists Town Clerk Richard W Kohler, phone 321-768-9109 and hours of Monday through Friday 8:30 a.m. to 5 p.m. (Town of Malabar). Section 14-42 has the Malabar town clerk keep a record of every receipt, its date of issuance, expiration and holder, and lets the clerk require updated applications (Malabar Town Code). Section 14-36 requires the receipt to be displayed in a conspicuous place at the business (Malabar Town Code).
Some files need more lead time. An applicant whose business requires approval of the Malabar building inspector must apply at least two weeks before the activity begins (Malabar Town Code). A mobile food dispensing vendor applying in Malabar must show a Florida Department of Business and Professional Regulation license, a Florida Department of Agriculture and Consumer Services mobile food establishment permit and a passed fire and safety inspection from the town fire department (Malabar Town Code).
Contractors meet the receipt again at the permit counter. The Malabar Building Department will not issue a permit unless the contractor's business tax receipt, general liability, workers compensation and contractor license are current on file with the town (Town of Malabar).
What does a Malabar business tax receipt cost?
A Malabar receipt costs whatever its classification lists in Section 14-46 of the town code, and any business the schedule does not name pays $300 a year (Malabar Town Code).
The Malabar schedule runs from item 1, abstract and title companies, to item 199, equestrian related boarding stables, and item 90.1, Home Based Business, is listed at $50.00 and marked as moved from Article V of the Land Development Code; the schedule was last amended by Ordinance 2021-10 (Malabar Town Code). The examples below come from that schedule.
| Malabar classification | Annual fee |
|---|---|
| Home Based Business | $50.00 |
| Mowing lawns | $40.00 |
| Handyman | $100.00 |
| Subcontractors (carpentry, painting, roofing, electrical and similar) | $50.00 |
| Contractor, Residential (Class 3) | $125.00 |
| Contractor, General (Class 1) | $175.00 |
| Professionals (attorneys, engineers, physicians and others) | $110.00 |
| Equestrian related boarding stable | $75.00 |
| Restaurants, first 50 chairs | $40.00 |
| Any business not named in the schedule | $300.00 |
Three other charges matter in Malabar. A new business obtaining its receipt after April 1 pays one-half of the fee for that year; moving a receipt to a new location inside town or transferring it to a new owner after a bona fide sale costs $3.00; and no part of a fee is refunded unless it was collected by mistake or error (Malabar Town Code).
When is the Malabar receipt due, and what are the late penalties?
Malabar receipts are due on or before October 1 each year, and a late renewal pays 10 percent of the fee for October plus 5 percent for each later month, up to 25 percent (Malabar Town Code).
When October 1 falls on a weekend or holiday, the Malabar fee is due the first working day after it, and no receipt is issued for more than one year (Malabar Town Code). The town clerk sends renewal notices at the end of each fiscal year, but Section 14-41 says not receiving one is no defense for nonpayment (Malabar Town Code).
| Month paid | Penalty added to the Malabar fee |
|---|---|
| By October 1 | None |
| October | 10 percent |
| November | 15 percent (10 + 5) |
| December | 20 percent (10 + 5 + 5) |
| January onward | 25 percent cap, and the town attorney may begin collection |
Operating with no receipt at all is treated more harshly than paying late. Section 14-50 adds a penalty of 25 percent of the amount due and requires the business to stop operating in Malabar until it holds a receipt, and collection procedures may be started by the town attorney against anyone without a receipt by January 1 (Malabar Town Code).
Malabar's penalty scale mirrors state law, though its due date does not. Section 205.053, Florida Statutes, makes receipts due by September 30, sets the same 10 percent and 5 percent monthly penalties capped at 25 percent, and exposes a business that has not paid within 150 days after the initial notice of tax due to civil actions, court costs and attorneys' fees (Florida Statutes).
Home based business rules in Malabar
A home-based business in Malabar's residential districts runs under a home based business tax receipt, issued on a sworn application to the town clerk, and the fee schedule lists it at $50.00 (Malabar Town Code).
Section 14-40.2 covers the RR-65, RS-21, RS-15, RS-10, RM-4, RM-6 and R-MH districts. The Malabar application asks for the applicant's name, the residence, a floor plan sketch, the days and hours of operation and a recent photo of the dwelling showing the whole front yard, driveways and carports (Malabar Town Code).
Only family members living in the Malabar home may work there, plus up to two employees or independent contractors who live elsewhere; the business may also have fifty remote employees who never work at the dwelling (Malabar Town Code). Retail sales happen only inside the house, no goods may be displayed where a street can see them, and signage is limited to what Florida law allows (Malabar Town Code).
Traffic and parking must look like any other Malabar residence. Commercial vehicles and trailers park in legal spaces, never in the right-of-way, on a sidewalk or on unimproved ground, and heavy equipment may not be visible from the street or neighboring land (Malabar Town Code). Incidental business activity may take place in accessory structures (Malabar Town Code).
How the Malabar receipt fits with the Brevard County receipt
A Malabar business also deals with the Brevard County Tax Collector, which says the local business tax is levied by Brevard County and municipalities, issues the county receipt, and tells a business located within a municipality to contact the municipality (Brevard County Tax Collector).
The county calendar runs slightly ahead of Malabar's: county renewals open July 1, receipts expire September 30 and become delinquent October 1 (Brevard County Tax Collector). The Tax Collector asks for an online change within 30 days of a new location, owner, mailing address, name or line of business, and its business tax line is (321) 264-6969 or (321) 633-2199 (Brevard County Tax Collector).
State rules travel with both receipts. Section 205.194, Florida Statutes, requires anyone applying for or renewing a local receipt in a profession regulated by the Department of Business and Professional Regulation, the Florida Supreme Court or another state agency to exhibit an active state certificate, registration or license (Florida Statutes), which matters for Malabar professionals; subsection (2) says the rule does not apply to several Chapter 489 contractor licensing sections. On the county side, a business name other than the owner's legal name is registered as a fictitious name with the Florida Division of Corporations at sunbiz.org (Brevard County Tax Collector). In Malabar the town receipt from Town Hall on Malabar Road comes first. Last verified: October 13, 2026, on the Town of Malabar website.
Frequently asked questions
Does a home business in Malabar need a business tax receipt?
Yes. The Town of Malabar FAQ says a home business needs a receipt under Chapter 14, Article II of the town code, and Section 14-40.2 sets the home based business rules for the RR-65, RS, RM and R-MH residential districts. The fee schedule lists a Home Based Business at $50.00.
When are Malabar business tax receipts due?
On or before October 1 each year, or the first working day after it when October 1 lands on a weekend or holiday. Malabar adds 10 percent for an October renewal and 5 percent more each month after, never more than 25 percent of the fee.
Can a Malabar business tax receipt be paid online?
Yes. Renewals are paid in the Town of Malabar portal by searching Existing BTRs by receipt number or business address and choosing Submit Payment. From October 1, 2026 card payments online carry a convenience fee of 3.5% or $2.00, whichever is higher.
Is the Malabar receipt the same as the Brevard County receipt?
No. The Brevard County Tax Collector issues the county receipt, notes that local business tax is levied by the county and by municipalities, and tells a business located within a municipality to contact the municipality. A Malabar business therefore starts at Town Hall on Malabar Road.
What happens if a Malabar business never gets a receipt?
Section 14-50 of the Malabar code adds a penalty of 25 percent of the amount due and requires the business to stop operating in town until it holds a receipt. The town attorney may start collection against businesses still without one on January 1.
